## 1. COMPANY INFORMATION

Saconde & Saconde, LLC (“Saconde,” “we,” “us,” or “our”) is a limited liability company organized in the United States.

**Legal name:** Saconde & Saconde, LLC
**Principal place of business:** New York, New York, United States
**Retail/showroom location:** 521 W 26th St, Floor 5, New York, NY 10001, United States
**Website:** [www.saconde.com](http://www.saconde.com/)
**Mobile applications:** Saconde mobile applications made available for iOS, Android, and other supported platforms
**General and privacy contact:** hello@saconde.com

These EU/UK Disclosures apply when you access or use our website, mobile applications, retail services, online marketplace, consignment services, buyout services, authentication services, customer support, communications, or related services from the European Union, European Economic Area, or United Kingdom.

## 2. IMPORTANT GEOGRAPHIC NOTICE

Saconde is established and primarily operates in the United States. The availability of our website or application in a particular country does not necessarily mean that Saconde actively markets, ships, purchases, consigns, or provides every service in that country.

Certain products, seller programs, payment methods, shipping options, promotions, or application features may not be available in all EU, EEA, or UK locations.

We may restrict, refuse, suspend, or cancel transactions where:

* we do not offer service to the applicable location;
* shipping, customs, sanctions, payment, fraud, authentication, or legal requirements cannot be satisfied;
* an item cannot lawfully be imported, exported, purchased, sold, or transported;
* the transaction creates an unacceptable legal, financial, operational, or fraud risk; or
* restrictions are reasonably necessary to comply with applicable law.

Nothing in these EU/UK Disclosures limits any mandatory consumer or data-protection right that cannot lawfully be waived.

## 3. SACONDE’S ROLE

Depending on the transaction, Saconde may act as:

* the direct seller of an item;
* the buyer of an item through a buyout transaction;
* a consignee or resale service provider selling an item on behalf of a consignor;
* an operator of an online marketplace or resale platform;
* an authentication, inspection, pricing, logistics, or payment facilitator; or
* a service provider supporting a transaction between other parties.

The applicable product page, order confirmation, seller agreement, consignment offer, buyout offer, invoice, or transaction record will identify or explain the nature of the applicable transaction.

Unless the product page or order confirmation clearly identifies a third-party professional trader as the seller, consumers should understand that their purchase contract is ordinarily formed with Saconde.

Private individuals who sell or consign items to Saconde do not necessarily act as professional traders. Consumer rights that apply to purchases from professional traders may not apply in the same manner to a direct transaction with a private individual. Where Saconde is the contracting seller, however, Saconde will honor consumer rights that apply to Saconde under mandatory law.

## 4. INFORMATION PROVIDED BEFORE PURCHASE

Before an EU, EEA, or UK consumer places an order, Saconde will make available, as applicable:

* the main characteristics of the item;
* the identity and contact details of the contracting seller;
* the total price, including applicable taxes collected by Saconde;
* known shipping, delivery, handling, insurance, customs, or other charges;
* the available payment methods;
* delivery arrangements and estimated delivery timing;
* any geographic or shipping restrictions;
* the applicable return, cancellation, or withdrawal rights;
* circumstances in which a withdrawal right does not apply;
* the consumer’s responsibility for return shipping, where permitted;
* the condition of pre-owned or vintage merchandise;
* applicable authenticity, conformity, or commercial-guarantee information;
* the duration and termination conditions of any continuing service;
* any required deposit or financial guarantee; and
* the steps necessary to conclude the contract.

The product listing, checkout screen, linked policies, and order confirmation collectively form part of the pre-contract information.

Customers must review the full item description, photographs, measurements, condition report, disclosed defects, included accessories, price, currency, shipping terms, and estimated duties before submitting an order.

## 5. ORDER PROCESS AND CONTRACT FORMATION

Products displayed on the website or application are invitations to submit an order and are not necessarily binding offers.

A customer submits an offer to purchase by completing checkout and selecting the button or control indicating that the order carries an obligation to pay.

Receipt of an automated order acknowledgment does not necessarily mean that the order has been accepted. A binding contract is formed when Saconde:

* sends an express order acceptance or shipping confirmation;
* completes any required verification and captures or confirms payment; or
* otherwise expressly confirms acceptance of the order.

Saconde may decline or cancel an order before acceptance because of inventory error, pricing error, suspected fraud, sanctions concerns, payment failure, inability to ship, legal restriction, authentication concern, item damage, or another legitimate reason.

If Saconde cancels an order after receiving payment, Saconde will return the applicable amount using the original payment method or another lawful method, subject to fraud, chargeback, sanctions, or legal restrictions.

## 6. PRICES, CURRENCY, TAXES, DUTIES, AND CUSTOMS

Prices may be displayed in U.S. dollars or another supported currency. Currency conversion estimates are provided for convenience and may differ from the amount charged by a payment provider or card issuer.

The final checkout page will identify the amount charged by Saconde. Banks, card issuers, payment processors, or other providers may impose conversion fees, international transaction fees, or other charges that Saconde does not control.

For international shipments:

* value-added tax, import VAT, customs duty, brokerage fees, clearance charges, and local taxes may apply;
* amounts may be collected at checkout, included in the purchase price, or collected upon importation;
* the importer of record may be the customer, Saconde, or a service provider, as stated during checkout;
* customers must provide accurate customs and identification information;
* customers must not request that Saconde misstate an item’s value, origin, description, or purpose; and
* refused or abandoned shipments may result in deductions for shipping, duty, tax, brokerage, storage, return, and handling costs to the extent permitted by law.

Where checkout identifies a shipment as “duties paid,” “taxes included,” “DDP,” or similar, Saconde or its logistics provider will arrange payment of the identified import charges. Where checkout identifies a shipment as “duties unpaid,” “taxes not included,” “DAP,” or similar, the recipient is responsible for import charges.

## 7. PRE-OWNED, VINTAGE, AND UNIQUE GOODS

Most Saconde merchandise is pre-owned, vintage, rare, limited, discontinued, or otherwise unique.

Normal wear, aging, patina, prior repair, odor, storage marks, hardware wear, creasing, color variation, minor scratches, or other characteristics may be consistent with a pre-owned item. Such characteristics will not constitute a lack of conformity when they were clearly disclosed, reasonably visible, expressly accepted, or reasonably expected considering the item’s age, price, description, and pre-owned nature.

Product photographs may be enlarged to show condition. Screen settings and lighting may affect color appearance.

Nothing in this section excludes liability for an item that fails to conform to mandatory consumer-law requirements.

## 8. EU AND EEA RIGHT OF WITHDRAWAL

Subject to the exclusions below, an EU or EEA consumer may withdraw from an eligible distance purchase without giving a reason within 14 days after the day on which the consumer, or a person designated by the consumer other than the carrier, acquires physical possession of the goods.

For an order containing multiple items delivered separately, the period generally begins after receipt of the final item.

To exercise the right of withdrawal, the consumer must send Saconde a clear statement before the withdrawal period expires.

**The consumer may contact:**

**Email:** hello@saconde.com
**Mail:** Saconde & Saconde, LLC, 521 W 26th St, Floor 5, New York, NY 10001, United States

The consumer may use the model withdrawal form at the end of these EU/UK Disclosures, but use of the form is not mandatory.

**Return deadline**

After notifying Saconde of withdrawal, the consumer must return the goods without undue delay and no later than 14 days after communicating the decision to withdraw.

Saconde will provide return instructions. Returns must be sent to the address specified in those instructions and not necessarily to the showroom address above.

**Return costs**

Unless Saconde agrees otherwise or failed to disclose the consumer’s responsibility, the consumer is responsible for the direct cost of returning the item.

Because Saconde deals in high-value merchandise, the consumer should use a trackable, insured, and appropriately secured shipping method. The consumer remains responsible for the return until it is delivered to the designated return location, except to the extent mandatory law provides otherwise.

**Refund timing**

Saconde will reimburse eligible payments received from the consumer, including the least expensive standard outbound delivery charge offered for the order, without undue delay and generally within 14 days after receiving the withdrawal notice.

Saconde may withhold reimbursement until it receives the returned item or the consumer provides evidence that the item was sent, whichever occurs first.

Saconde may exclude additional delivery costs resulting from the consumer’s selection of an expedited or premium delivery method.

The refund will ordinarily be issued using the original payment method unless the consumer expressly agrees otherwise and does not incur additional fees as a result.

**Diminished value**

The consumer is responsible for diminished value resulting from handling beyond what is necessary to establish the item’s nature, characteristics, condition, authenticity indicators, and functioning.

Removal, alteration, or damage to Saconde tags, security devices, authenticity seals, return labels, serial-number records, protective materials, or included accessories may result in a lawful deduction if the conduct diminished the value of the item.

The right of withdrawal is not a right to use, wear, alter, repair, clean, transfer, or resell an item before returning it.

## 9. UK CANCELLATION RIGHT

Subject to applicable exclusions, a UK consumer may cancel an eligible distance purchase within 14 days after the day on which the consumer, or a person identified by the consumer other than the carrier, takes physical possession of the goods.

The notice, return, cost, reimbursement, and diminished-value provisions in Section 8 apply to UK cancellations to the extent consistent with UK law.

Nothing in Saconde’s policies reduces any longer or additional remedy that applies where goods are faulty, misdescribed, not fit for purpose, or otherwise fail to conform to the contract.

## 10. EXCLUSIONS FROM WITHDRAWAL OR CANCELLATION

A statutory withdrawal or cancellation right may not apply, or may end early, where permitted by applicable law, including for:

* goods made to the consumer’s specifications or clearly personalized;
* sealed goods that are not suitable for return for health-protection or hygiene reasons after unsealing;
* goods that become inseparably mixed with other items after delivery;
* services fully performed after the consumer expressly requested immediate performance and acknowledged the effect on the cancellation right;
* digital content supplied without a tangible medium after the consumer gave prior express consent to immediate supply and acknowledged the resulting loss of the cancellation right;
* goods subject to genuine price fluctuations in a financial market that Saconde cannot control;
* qualifying public-auction transactions where the consumer had the opportunity to attend in person; or
* other transactions excluded by mandatory law.

An item is not excluded merely because it is pre-owned, luxury, discounted, marked “final sale,” sold through an application, or authenticated. “Final sale” language does not override a mandatory statutory cancellation right.

## 11. FAULTY, MISDESCRIBED, OR NONCONFORMING GOODS

Withdrawal or change-of-mind rights are separate from a consumer’s remedies for defective, damaged, misdescribed, inauthentic, or nonconforming goods.

Where mandatory EU, EEA, or UK consumer law applies, Saconde will provide the remedies required by that law. Depending on the circumstances, these may include repair, replacement, price reduction, rejection, cancellation, or refund.

The appropriate remedy may depend on:

* the jurisdiction;
* the time elapsed after delivery;
* whether repair or replacement is possible;
* whether the item is unique;
* the seriousness of the nonconformity;
* whether the condition was disclosed before purchase; and
* whether the consumer caused or contributed to the issue.

For unique pre-owned goods, an identical replacement may not be available. Where replacement is impossible, another legally required remedy will be offered.

Consumers should notify Saconde promptly and provide photographs, video, packaging, shipment records, and other information reasonably necessary to investigate the claim. Failure to notify Saconde immediately does not waive a mandatory right where applicable law provides otherwise.

## 12. AUTHENTICITY CLAIMS

Saconde evaluates authenticity using internal personnel, available documentation, technology, databases, third-party authenticators, and other methods that Saconde considers appropriate.

If a consumer reasonably believes an item is inauthentic, the consumer should stop using or transferring the item and contact **hello@saconde.com** with:

* the order number;
* photographs of the item and relevant identifying features;
* the basis for the concern;
* any written third-party assessment; and
* any other supporting documentation.

Saconde may require return of the item for inspection. Saconde may reject unsupported, altered, substituted, or fraudulent claims.

Nothing in this section limits mandatory remedies for goods that do not conform to their description.

## 13. DELIVERY AND RISK

Estimated delivery dates are estimates unless Saconde expressly agrees to a guaranteed date.

Risk of accidental loss generally passes as provided by applicable law. For consumer shipments arranged by Saconde, risk ordinarily remains with the contracting seller until the consumer or the consumer’s designated recipient takes physical possession, except where the consumer independently appoints a carrier not offered by Saconde and mandatory law permits risk to pass upon delivery to that carrier.

Customers must provide a secure and accurate delivery address. Signature, identification, age, or delivery verification may be required.

## 14. COMPLAINTS AND DISPUTE RESOLUTION

Consumers may submit complaints to:

**Email:** hello@saconde.com
**Mail:** Saconde, LLC, 521 W 26th St, Floor 5, New York, NY 10001, United States

Please include the order number, account email, relevant dates, requested resolution, and supporting evidence.

Saconde will attempt to respond within a reasonable time. Complex authenticity, payment, customs, fraud, or carrier matters may require additional investigation.

The European Commission’s former Online Dispute Resolution platform has been discontinued. Saconde does not represent that it participates in any particular EU or UK alternative dispute-resolution body unless Saconde expressly identifies that body in writing.

Consumers may contact an applicable national consumer authority, approved alternative dispute-resolution provider, local trading standards authority, or court where legally available.

## 15. GOVERNING LAW AND MANDATORY CONSUMER PROTECTIONS

Saconde’s applicable Terms may select New York law and a dispute forum. That selection does not deprive an EU, EEA, or UK consumer of mandatory protections that apply under the law of the consumer’s habitual residence and cannot lawfully be waived by contract.

Any arbitration, class-action waiver, limitation of liability, disclaimer, shortened claim period, or forum provision applies only to the extent enforceable under applicable law.

Nothing in Saconde’s policies:

* excludes liability for fraud or fraudulent misrepresentation;
* excludes liability for death or personal injury caused by negligence where such exclusion is prohibited;
* excludes mandatory liability for defective products;
* limits a mandatory consumer remedy;
* requires a consumer to waive a nonwaivable right; or
* prevents a consumer from contacting a regulator or enforcement authority.

## 16. EU GDPR AND UK GDPR APPLICABILITY

This section supplements Saconde’s Privacy Policy for individuals located in the EU, EEA, or UK.

Saconde acts as a data controller when it determines why and how personal data is processed for its own business purposes.

Saconde may act as a processor or service provider where it processes information solely on documented instructions from another controller. Where Saconde acts only as a processor, the applicable controller’s privacy notice governs the processing.

## 17. CATEGORIES OF PERSONAL DATA

Saconde may process:

* identity and contact information;
* account credentials and profile information;
* purchase, sale, consignment, buyout, return, and transaction information;
* payment and payout information;

* government-issued identification and verification results;
* item photographs, serial numbers, date codes, receipts, provenance, and ownership information;
* customer-support and communications records;
* device identifiers, IP address, browser, operating system, application version, and network information;

* reviews, comments, listings, and other user-generated content;
* inferred interests, preferences, transaction patterns, or risk indicators; and
* other information described at the point of collection.

Saconde does not intend to collect special-category data unless necessary and lawful. Identification documents or photographs may incidentally reveal sensitive characteristics. Saconde does not use such incidental information to infer sensitive traits unless legally authorized and necessary for a disclosed purpose.

## 18. PURPOSES AND LAWFUL BASES

Saconde may process personal data under one or more of the following lawful bases:

**Performance of a contract or pre-contract steps**

We process information to:

* create and administer accounts;
* respond to transaction inquiries;

Subject to a balancing assessment, we may process information to:

* secure our website, application, premises, users, employees, and inventory;

We may rely on consent for:

* nonessential cookies, SDKs, and similar technologies;
* certain personalized advertising;
* certain email, SMS, push-notification, or electronic marketing;
* precise location access;
* device permissions;
* optional biometric or similar features, where offered;
* optional surveys or research; and
* other processing for which consent is the appropriate lawful basis.

A person may withdraw consent at any time. Withdrawal does not affect processing that occurred lawfully before withdrawal.

**Vital interests or public-interest grounds**

In limited circumstances, Saconde may process information to protect a person’s vital interests or for another legally recognized public-interest basis.

## 19. REQUIREMENT TO PROVIDE INFORMATION

Certain personal data is required to enter into or perform a contract, receive payment, obtain a payout, clear customs, verify identity, prevent fraud, or comply with law.

When required information is not provided, Saconde may be unable to create an account, complete a purchase, accept a consignment, make a buyout offer, issue a payout, ship an item, process a return, or provide another requested service.

Optional fields will generally be identified as optional or apparent from the context.

## 20. DATA SOURCES

Saconde may obtain personal data:

* directly from the individual;
* from buyers, sellers, consignors, authorized users, or representatives;
* from payment processors, financial institutions, and payout providers;
* from shipping, logistics, customs, and insurance providers;

* from application stores, operating systems, social networks, advertising partners, and analytics providers;
* from publicly available sources;

* from brand owners, rights holders, marketplaces, and resale platforms; and
* through cookies, SDKs, pixels, device permissions, and similar technologies.

## 21. RECIPIENTS OF PERSONAL DATA

Saconde may disclose personal data to:

* cloud-hosting and information-technology providers;
* payment processors, banks, card networks, and payout providers;
* identity-verification, fraud-prevention, sanctions-screening, and security vendors;
* authentication, appraisal, repair, cleaning, photography, storage, and fulfillment providers;

* government, regulators, courts, law enforcement, and other parties where required or legally appropriate;
* prospective purchasers, investors, lenders, or successors involved in a business transaction; and
* other recipients disclosed when information is collected.

Saconde does not authorize recipients to use personal data for unrelated purposes when they process it solely on Saconde’s behalf.

## 22. INTERNATIONAL DATA TRANSFERS

Saconde is based in the United States. Personal data collected from EU, EEA, or UK individuals may be transferred to and processed in the United States and other countries that may not provide the same level of statutory data protection as the person’s home jurisdiction.

Where required, Saconde will use a recognized transfer mechanism, which may include:

* an adequacy decision;
* the European Commission’s Standard Contractual Clauses;
* the UK International Data Transfer Agreement;
* the UK Addendum to the European Commission’s Standard Contractual Clauses;
* an approved certification mechanism;
* binding corporate rules, where applicable;
* an applicable statutory derogation; or
* another legally recognized safeguard.

Saconde may conduct transfer-risk assessments and implement supplementary contractual, technical, or organizational safeguards where required.

Individuals may contact hello@saconde.com to request information about the applicable transfer safeguards. Saconde may provide a summary or redacted copy where necessary to protect confidential information and third-party rights.

## 23. RETENTION

Saconde retains personal data only for as long as reasonably necessary for the applicable purposes, including to:

* maintain accounts and provide services;
* complete transactions and honor warranties;
* investigate authenticity, fraud, theft, loss, returns, and disputes;
* comply with tax, accounting, customs, consumer, sanctions, and other legal obligations;
* enforce agreements;
* establish, exercise, or defend legal claims;
* maintain security and business-continuity records; and
* satisfy applicable limitation periods.

Retention periods vary by record type, jurisdiction, transaction risk, contractual obligation, legal requirement, and operational need.

When data is no longer required, Saconde will delete, anonymize, aggregate, or securely isolate it, subject to lawful backup and archival practices.

## 24. AUTOMATED PROCESSING AND PROFILING

Saconde may use automated tools, algorithms, artificial intelligence, rules, or scoring systems to assist with:

* fraud and chargeback detection;
* account and transaction risk;
* sanctions and identity screening;
* authentication review;
* listing categorization;
* price recommendations;
* counterfeit detection;
* marketing measurement;
* personalization;
* content moderation; and
* security monitoring.

These tools may generate recommendations, flags, rankings, predictions, or risk scores. Human personnel may review relevant results.

Saconde does not intend to make a decision based solely on automated processing that produces legal or similarly significant effects unless:

* it is necessary to enter into or perform a contract;
* it is authorized by applicable law with suitable safeguards; or
* the individual has provided explicit consent.

Where a person has a legal right concerning a solely automated significant decision, the person may request human intervention, express a point of view, and contest the decision.

## 25. EU, EEA, AND UK DATA-PROTECTION RIGHTS

Subject to applicable conditions and exceptions, individuals may have the right to:

* obtain confirmation that Saconde processes their personal data;
* access their personal data;
* correct inaccurate or incomplete data;
* request deletion;
* restrict processing;
* object to processing based on legitimate interests;
* object to direct marketing at any time;
* receive certain data in a structured, commonly used, machine-readable format;
* transmit eligible data to another controller;
* withdraw consent;
* receive information about international-transfer safeguards;
* request safeguards concerning qualifying automated decisions; and
* complain to a supervisory authority.

Rights are not absolute. Saconde may retain or continue processing information where authorized or required by law, including for legal obligations, freedom of expression, fraud prevention, public interest, or legal claims.

## 26. EXERCISING PRIVACY RIGHTS

**Requests may be submitted to:**

**Email:** hello@saconde.com
**Mail:** Saconde & Saconde, LLC, 521 W 26th St, Floor 5, New York, NY 10001, United States

The request should describe the right being exercised and identify the relevant account or transaction.

Saconde may request information reasonably necessary to verify identity and prevent unauthorized access or deletion. Saconde will not request more verification information than reasonably necessary.

Saconde generally responds within one month after receiving a valid request. Where legally permitted, Saconde may extend the response period because of complexity or the number of requests and will provide notice of the extension.

Saconde ordinarily does not charge a fee. A reasonable fee may apply, or Saconde may refuse to act, where a request is manifestly unfounded or excessive, particularly because it is repetitive, to the extent permitted by law.

Authorized representatives may submit requests where applicable, but Saconde may require evidence of authority and may verify the request directly with the individual.

## 27. DIRECT MARKETING

Individuals may opt out of marketing emails by using the unsubscribe mechanism in the message or contacting **hello@saconde.com**.

Marketing consent is separate from acceptance of Saconde’s general Terms and is not required to complete an ordinary purchase unless the communication is necessary to provide the requested service.

Saconde may send non-marketing communications concerning orders, accounts, security, seller submissions, payments, payouts, returns, legal notices, or service changes even after a marketing opt-out.

Where Saconde relies on a permitted existing-customer exception for marketing similar products or services, Saconde will provide a clear opt-out when contact details are collected and in each marketing message.

## 28. COOKIES, SDKS, AND DEVICE STORAGE

Saconde’s website and application may use cookies, SDKs, pixels, local storage, device identifiers, scripts, APIs, and similar technologies.

Where required by EU, EEA, or UK law:

* nonessential technologies will not be activated until valid consent is obtained;
* consent choices will be presented clearly;
* rejecting nonessential technologies will be as accessible as accepting them;
* consent will not be obtained through preselected boxes or inactivity;
* consent may be withdrawn through the cookie or privacy settings;
* withdrawal will be as easy as giving consent; and
* strictly necessary technologies may operate without consent where legally permitted.

Users should review Saconde’s Cookie Policy and cookie-preference tool for additional details.

Application permissions, including notifications, camera, photographs, location, Bluetooth, microphone, or biometric access, may also be controlled through the device’s operating-system settings.

## 29. CHILDREN

Saconde’s services are not directed to children. A person must have the legal capacity required by applicable law to create an account, purchase, sell, consign, or enter into another transaction.

Saconde does not knowingly use consent as the basis for providing an online service directly to a child below the applicable digital-consent age without legally sufficient parental authorization.

If Saconde learns that it collected a child’s personal data unlawfully, it will take reasonable steps to delete or otherwise address the information.

## 30. SECURITY

Saconde uses administrative, technical, physical, and organizational safeguards designed to protect personal data and high-value transactions.

No internet transmission, mobile application, storage system, authentication process, or security measure is completely secure. Users must protect account credentials, devices, email accounts, verification codes, and payment information and must promptly report suspected unauthorized activity.

## 31. PERSONAL-DATA BREACHES

Saconde maintains procedures for evaluating and responding to suspected personal-data breaches.

Where legally required, Saconde will notify the appropriate supervisory authority and affected individuals within the applicable period, taking into account the nature, likelihood, and severity of the risk.

## 34. DATA PROTECTION OFFICER

Saconde has not designated a Data Protection Officer. Privacy questions may be sent to **hello@saconde.com**.

## 35. SUPERVISORY-AUTHORITY COMPLAINTS

EU and EEA individuals may complain to the data-protection supervisory authority in the country where they live, work, or believe an infringement occurred.

UK individuals may complain to the UK Information Commissioner’s Office.

Saconde encourages individuals to contact **hello@saconde.com** first so that Saconde has an opportunity to address the concern, but contacting Saconde first is not a condition of filing a regulatory complaint.

## 36. SELLERS AND CONSIGNORS IN THE EU, EEA, OR UK

EU, EEA, and UK sellers or consignors must provide truthful information concerning:

* identity and legal capacity;
* ownership and authority to sell;
* professional-trader status;
* item origin, condition, authenticity, and provenance;
* customs and export requirements;
* tax-registration or reporting status;
* whether the item is subject to liens, claims, restrictions, or intellectual-property concerns; and
* any information legally required to be disclosed to a buyer.

Saconde may be legally required to collect, verify, retain, or report seller identity and transaction information to tax authorities, regulators, customs authorities, marketplaces, payment providers, or law enforcement.

A seller who acts for purposes relating to a trade, business, craft, or profession may be treated as a professional trader even if the seller describes themselves as an individual.

Professional sellers must identify themselves accurately and comply with all consumer, tax, product-safety, labeling, and trading obligations applicable to them.

## 37. PRODUCT SAFETY AND RECALLS

Saconde may remove, suspend, recall, repair, refund, or restrict products where Saconde becomes aware of a product-safety concern, legal prohibition, regulatory notice, or recall.

Customers should follow safety warnings and recall instructions. Saconde may contact customers using available transaction information where necessary to communicate a safety issue.

## 38. ACCESSIBILITY AND LANGUAGE

Saconde seeks to make material consumer and privacy information clear and accessible.

English is the controlling language of Saconde’s policies unless mandatory local law requires otherwise. Any translation is provided for convenience unless expressly identified as controlling.

A consumer’s mandatory right to receive information in another language is not waived by this section.

## 39. APPLICATION-STORE DISCLOSURES

The Saconde application may be downloaded through third-party application stores.

The applicable application-store operator:

* is not generally a party to transactions between Saconde and users;
