* any other Saconde service that links to this Form or our Privacy Policy.

Residents of any U.S. state may submit a request using this Form. The specific rights available to you depend on your state of residence, the nature of your relationship with Saconde, the type of information involved, whether Saconde is subject to the applicable law, and any legal exceptions.

Submitting this Form does not guarantee that every selected request will apply to every category of information. We will evaluate and process each request in accordance with applicable law.

## 2. YOUR PRIVACY CHOICES

Depending on applicable law, you may have one or more of the following rights:

**A. Right to Confirm Processing**

You may request confirmation of whether Saconde processes personal information about you.

**B. Right to Know or Access**

You may request access to personal information Saconde maintains about you.

Depending on applicable law, this may include:

* categories of personal information collected;
* specific pieces of personal information;
* categories of sources from which the information was collected;
* business or commercial purposes for collecting, using, selling, sharing, or otherwise processing the information;
* categories of third parties to whom information was disclosed;
* categories of personal information sold, shared, or disclosed; and
* other information required by applicable law.

**C. Right to Obtain a Copy or Data Portability**

You may request a copy of eligible personal information in a portable and, where technically feasible, readily usable format that allows you to transmit the information to another entity.

The right to obtain specific pieces of information may be limited when disclosure would create a material security, fraud, confidentiality, intellectual-property, or legal risk.

**D. Right to Delete**

You may request deletion of eligible personal information maintained about you.

We may retain information when permitted or required for purposes such as:

* completing a transaction you requested;
* providing goods or services;
* processing returns, refunds, consignments, buyouts, payouts, or claims;
* authenticating merchandise;
* detecting fraud, counterfeit merchandise, theft, money laundering, sanctions violations, or other unlawful activity;
* protecting accounts, systems, users, employees, inventory, and property;
* maintaining transaction, tax, accounting, and audit records;
* complying with legal, regulatory, insurance, law-enforcement, or contractual requirements;
* exercising or defending legal claims;
* enforcing our agreements and policies;
* maintaining suppression records necessary to honor an opt-out request;
* correcting technical errors;
* preserving evidence;
* conducting internal uses reasonably aligned with consumer expectations; or
* completing another activity permitted by applicable law.

Deletion from active systems may not result in immediate deletion from disaster-recovery or backup systems. Information retained in backups will remain protected and will be deleted or rendered inaccessible in accordance with our retention practices, unless continued retention is required by law.

**E. Right to Correct**

You may request correction of inaccurate personal information maintained about you.

We may ask you to provide documentation reasonably necessary to evaluate the accuracy of the information and the requested correction.

**F. Right to Opt Out of Sale of Personal Information or Personal Data**

You may request that Saconde not sell your personal information or personal data as those terms are defined under applicable law.

“Sale” may have different definitions in different states and may include certain transfers of personal information for monetary or other valuable consideration.

Saconde will process an applicable opt-out request even if Saconde does not currently engage in an activity legally defined as a sale. We may retain a record of the request so that we can continue honoring your preference.

**G. Right to Opt Out of Sharing for Cross-Context Behavioral Advertising**

California residents may request that Saconde not share personal information for cross-context behavioral advertising as defined by California law.

**H. Right to Opt Out of Targeted Advertising**

Residents of states providing this right may request that Saconde not process personal data for targeted advertising as defined by applicable law.

This may affect advertising based on activity across nonaffiliated websites, applications, services, or devices. It generally does not prevent:

* contextual advertising;
* advertising based on your activity within Saconde’s own services;
* communications about your transactions or account;
* measurement, attribution, reporting, security, or fraud-prevention activities permitted by law; or
* advertisements that do not involve covered targeted-advertising practices.

**I. Right to Opt Out of Certain Profiling or Automated Decisions**

Residents of states providing this right may request to opt out of qualifying profiling in furtherance of decisions that produce legal or similarly significant effects.

Depending on applicable law, qualifying decisions may include decisions concerning:

* financial or lending services;
* housing;
* insurance;
* education enrollment;
* employment opportunities;
* health care services;
* access to essential goods or services; or
* other matters specifically covered by law.

Saconde may use automated tools to assist with fraud detection, identity verification, security, authentication, product recommendations, pricing analysis, customer support, inventory review, or similar operational activities. Not all automated processing constitutes legally regulated profiling or produces legal or similarly significant effects.

**J. Right to Limit Certain Uses or Disclosures of Sensitive Personal Information**

Where applicable, you may request that Saconde limit certain uses or disclosures of sensitive personal information to uses permitted without a right to limit.

Sensitive information may include, depending on the applicable law:

* government-issued identification information;
* account login credentials;
* precise geolocation;
* racial or ethnic origin;
* religious or philosophical beliefs;
* union membership;
* genetic data;
* biometric information used for identification;
* information concerning health, sex life, or sexual orientation;
* citizenship or immigration status;
* financial account information;
* contents of private communications; or
* other information classified as sensitive under applicable law.

This right may not apply where sensitive information is used only for legally permitted purposes, such as providing requested services, verifying identity, preventing fraud, maintaining security, processing payments, or complying with law.

**K. Right to Withdraw Consent**

Where Saconde relies on your consent to process personal information, you may withdraw that consent, subject to applicable law.

Withdrawal will not affect processing that occurred before withdrawal. We may continue processing information under another lawful basis or legal exception.

**L. Right to Opt Out of Consumer Health Data Collection, Sharing, or Sale**

Where applicable under Washington’s My Health My Data Act, Nevada consumer-health-data law, or another state health-data law, you may request to:

* access consumer health data;
* obtain a list of third parties or affiliates with whom consumer health data was shared or sold, where required;
* withdraw consent for collection or sharing;
* delete consumer health data;
* opt out of or withhold authorization for the sale of consumer health data; or
* exercise other rights provided by applicable law.

Saconde is not a health care provider and does not intend to provide medical services. However, information may be treated as consumer health data under certain state laws if it reveals or permits an inference about a person’s physical or mental health.

**M. Right Concerning Biometric Information**

Where applicable, you may request information about, withdraw consent for, or request deletion of biometric identifiers or biometric information maintained by Saconde.

Saconde’s mobile applications may allow you to use device-based features such as Face ID, Touch ID, Android biometric authentication, or similar technology. In ordinary device-based biometric login, the device platform generally performs the biometric match and Saconde receives an authentication result rather than your raw fingerprint or facial template.

Any separate collection of biometric identifiers by or on behalf of Saconde will be governed by applicable notices, consents, and retention requirements.

**N. Right to Opt Out of Certain Data-Broker Activities**

Where applicable, consumers may have rights involving data brokers, including rights to opt out of sale, request deletion, or use a state-operated data-broker deletion or opt-out mechanism.

Saconde’s availability through a data-broker registry or centralized deletion system, if any, will depend on whether Saconde meets the applicable definition of a data broker.

**O. Right to Appeal**

Residents of states providing an appeal right may appeal Saconde’s refusal or partial refusal of a privacy request.

Instructions for appealing will be included in the response to the original request. You may also submit an appeal using this Form by selecting “Appeal a Privacy Decision.”

**P. Right to Non-Discrimination and Equal Service**

Saconde will not unlawfully discriminate or retaliate against you for exercising an applicable privacy right.

We will not unlawfully:

* deny goods or services;
* charge different prices or rates;
* provide a different level or quality of goods or services;
* retaliate against an employee, applicant, or contractor; or
* suggest that you will receive a different price, rate, level, or quality of service.

We may offer a lawful financial incentive, price difference, loyalty program, or benefit related to the collection, retention, or use of personal information when permitted by law and accompanied by any required notice and consent.

A difference in service is not discriminatory when reasonably related to the value of the information, necessary to fulfill your request, or otherwise permitted by law.

## 11. VERIFICATION

To protect consumers and prevent unauthorized access, deletion, account takeover, fraud, or identity theft, Saconde may verify your identity before fulfilling certain requests.

Verification may include matching information provided in the request with information already maintained by Saconde, such as:

Saconde may be unable to fulfill a request if we cannot reasonably verify your identity or authority. We may explain the basis for that decision and provide appeal instructions when required.

An opt-out request ordinarily will not require identity verification, although we may request information necessary to identify the applicable consumer, browser, device, account, or records and prevent fraudulent requests.

**Attn: Privacy Rights Request**
**521 W 26th St, Floor 5**
**New York, NY 10001**
**United States**

For security and operational reasons, submitting a request by email or through an online privacy portal is recommended. In-store employees may forward a request to the appropriate privacy personnel and may not be able to complete the request immediately.

You do not have to use this exact Form if your request otherwise provides sufficient information for Saconde to understand, evaluate, and respond to it.

Accessibility assistance and alternative formats may be requested by contacting hello@saconde.com.

## 14. GLOBAL PRIVACY CONTROL AND UNIVERSAL OPT-OUT MECHANISMS

Where required by applicable law, Saconde will process a recognized Global Privacy Control signal or other legally valid universal opt-out mechanism as a request to opt out of covered sale, sharing, or targeted-advertising activities.

A browser-based signal generally applies to the browser or device transmitting the signal. When you are logged into a Saconde account and applicable law requires it, Saconde may apply the preference to the associated account.

Saconde may not be able to associate a browser or device signal with an offline identity, another device, or an account when the signal does not provide sufficient information or when such association is not legally required.

## 15. PROCESSING AND RESPONSE PERIODS

Saconde will confirm receipt and respond within the period required by applicable law.

Depending on the controlling law and request type:

* an initial response may generally be required within approximately 30 to 45 days;
* California requests to know, delete, or correct may require confirmation of receipt within the legally prescribed period;
* additional time may be available when reasonably necessary, taking into account the complexity and number of requests;
* a shorter period may apply to certain consumer health data requests or other specialized requests;
* opt-out requests may be processed within a shorter statutory period; and
* appeal decisions may be subject to separate deadlines.

If an extension is permitted and necessary, Saconde will provide notice and explain the reason for the extension.

Saconde may respond by:

* granting the request;
* granting the request in part;
* requesting additional information or verification;
* explaining that no responsive information was located;
* explaining that the request cannot be fulfilled;
* identifying an applicable exception; or
* providing appeal instructions when required.

## 16. FEES AND EXCESSIVE REQUESTS

Saconde generally will not charge a fee for processing a valid privacy request.

Where permitted by law, Saconde may charge a reasonable fee or decline to act when a request is manifestly unfounded, technically infeasible, excessive, repetitive, or abusive. Before charging a fee, we will provide any notice required by law.

## 17. FREQUENCY LIMITATIONS

Certain laws limit how frequently a consumer may submit particular requests, including requests for access to specific pieces of personal information.

Where a statutory frequency limit applies, Saconde may deny or limit a duplicative request submitted within the applicable period. Opt-out and consent-withdrawal rights will be handled according to the separate requirements applicable to those rights.

## 18. INFORMATION THAT MAY BE EXCLUDED

Privacy rights may not apply to all information or processing activities.

Depending on applicable law, rights may be limited for:

* publicly available information;
* deidentified or aggregated data;
* information subject to federal financial-privacy laws;
* consumer-reporting information;
* health or medical information regulated by other laws;
* driver or motor-vehicle records;
* education records;
* employment or applicant information;
* business-to-business contact information;
* information processed solely in a commercial or employment context;
* information maintained on behalf of another business for which Saconde acts as a service provider or processor;
* information covered by legal privilege;
* information necessary to comply with law or legal process;
* information necessary to establish, exercise, or defend legal claims;
* information necessary for security, fraud prevention, authentication, counterfeit detection, or public safety;
* information necessary to complete a requested transaction;
* information whose disclosure would adversely affect another person’s rights;
* trade secrets, proprietary information, or intellectual property; or
* other exempt information or processing recognized by applicable law.

Where Saconde processes information solely for another business, we may direct you to submit your request to that business.

## 19. APPEALING A DECISION

Where applicable law provides an appeal right, you may appeal a denial or partial denial by:

* selecting “Appeal a Prior Privacy-Request Decision” on this Form;
* emailing hello@saconde.com with the subject line “Privacy Request Appeal”; or

## STATE-SPECIFIC PRIVACY RIGHTS

## 20. APPLICATION ACROSS ALL 50 STATES

This Form is available to residents of:

Alabama, Alaska, Arizona, Arkansas, California, Colorado, Connecticut, Delaware, Florida, Georgia, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Utah, Vermont, Virginia, Washington, West Virginia, Wisconsin, and Wyoming.

Saconde will also accept requests from residents of the District of Columbia and U.S. territories when applicable.

Not every state provides the same consumer privacy rights, and some state laws apply only when a business meets specified revenue, processing-volume, business-model, or other thresholds. By accepting requests from every state, Saconde does not represent that every state’s comprehensive privacy law applies to Saconde or that every listed right is available in every circumstance.

When a state does not provide a particular statutory right, Saconde may consider the request voluntarily but may deny or limit it based on operational, security, contractual, or legal requirements.

## 21. CALIFORNIA

Subject to the California Consumer Privacy Act, as amended by the California Privacy Rights Act, eligible California residents may have rights to:

* know or access categories and specific pieces of personal information;
* know categories of sources, purposes, and recipients;
* delete eligible personal information;
* correct inaccurate personal information;
* opt out of the sale of personal information;

* have qualifying opt-out preference signals honored.

Depending on the circumstances, California law may also provide rights relating to minors’ personal information, data brokers, direct-marketing disclosures, customer-record confidentiality, online privacy disclosures, and security incidents.

California residents may submit requests using this Form or any separate “Your Privacy Choices,” “Do Not Sell or Share My Personal Information,” or “Limit the Use of My Sensitive Personal Information” interface made available by Saconde.

Saconde will not use information submitted in connection with an opt-out request for a purpose other than processing the request, maintaining compliance records, and preventing fraud, except as permitted by law.

California’s “Shine the Light” law may permit certain residents to request information concerning specified disclosures of personal information to third parties for their own direct-marketing purposes. Such a request may be submitted to hello@saconde.com with the subject line “California Shine the Light Request.”

## 22. COLORADO, CONNECTICUT, DELAWARE, IOWA, INDIANA, KENTUCKY, MARYLAND, MINNESOTA, MONTANA, NEBRASKA, NEW HAMPSHIRE, NEW JERSEY, OREGON, RHODE ISLAND, TENNESSEE, TEXAS, UTAH, AND VIRGINIA

* receive non-discriminatory treatment.

The precise rights, definitions, exemptions, response periods, consent requirements, recognized opt-out signals, and appeal procedures vary by state.

Some laws provide additional protections involving:

* children’s or teenagers’ data;
* sensitive data;
* precise geolocation;
* biometric or genetic data;
* consumer health data;
* financial information;
* profiling;
* data obtained from third parties;

* lists of third parties receiving personal data.

Saconde will apply the protections required by the law governing the request.

## 23. FLORIDA

Eligible Florida residents may have rights under the Florida Digital Bill of Rights or other Florida privacy laws when the applicable law and coverage requirements are satisfied.

These rights may include access, correction, deletion, portability, opt-out rights, and protections involving children, sensitive data, voice or facial recognition technology, precise geolocation, targeted advertising, sale, and profiling.

Because Florida’s comprehensive law applies only to specified covered entities, not every Florida request will qualify under that law. Saconde will also evaluate requests under other applicable Florida and federal laws.

## 24. NEVADA

Eligible Nevada residents may request to review or correct certain covered information and may direct an operator not to make a covered sale of covered information, subject to Nevada law.

Nevada’s definition of “sale” may differ from definitions used in other states.

Nevada residents may also have rights relating to consumer health data, including rights to access, delete, withdraw consent, and withhold authorization for certain sales, subject to applicable law.

## 25. WASHINGTON

Washington residents may have rights under the Washington My Health My Data Act concerning consumer health data.

Depending on applicability, these rights may include:

* confirming whether Saconde collects, shares, or sells consumer health data;
* accessing consumer health data;
* receiving information concerning sources and recipients;
* withdrawing consent to collection or sharing;
* requesting deletion;
* withholding or revoking authorization for sale; and
* receiving disclosures required by law.

Deletion requests may require Saconde to notify processors, affiliates, or other third parties where required. Deletion from archived or backup systems may occur in accordance with the statutory schedule.

Washington residents may also exercise rights available under other Washington privacy, biometric, health, data-security, and consumer-protection laws.

## 26. ILLINOIS, TEXAS, AND WASHINGTON BIOMETRIC RIGHTS

Residents may have protections under state biometric privacy laws, including the Illinois Biometric Information Privacy Act, the Texas Capture or Use of Biometric Identifier Act, and Washington biometric privacy law.

Where applicable, these protections may concern:

* notice before collection;
* the purposes and duration of collection;
* consent;
* restrictions on sale or disclosure;
* reasonable security;
* retention schedules; and
* permanent destruction.

Device-based biometric login operated by Apple, Google, or a device manufacturer may be performed locally by the device without providing Saconde the underlying biometric identifier.

Requests concerning biometric information may be submitted using this Form.

## 27. NEW YORK

New York residents may exercise rights available under applicable New York laws governing:

* data security;
* breach notification;
* identity theft;
* financial information;
* medical information;

## 28. OREGON AND MINNESOTA THIRD-PARTY INFORMATION

Where required by applicable state law, an eligible resident may request information identifying third parties to which Saconde disclosed personal data.

Saconde may provide the information in the form required by the applicable statute and may rely on statutory exceptions.

## 29. MARYLAND DATA-MINIMIZATION AND SENSITIVE-DATA RIGHTS

Where applicable, eligible Maryland residents may have heightened protections involving:

* collection reasonably necessary and proportionate to provide or maintain a requested product or service;
* processing of sensitive data;
* sale of sensitive data;
* targeted advertising;

* state laws concerning targeted advertising, profiling, sale, or sharing involving minors.

Saconde’s services are not directed to children under 13\. Saconde does not knowingly collect personal information from a child under 13 without legally required parental consent.

A parent or guardian who believes a child provided personal information may submit a deletion or other privacy request through this Form.

## 31. GENETIC, HEALTH, AND REPRODUCTIVE OR SEXUAL-HEALTH INFORMATION

Certain states provide specialized protections for genetic data, health data, reproductive or sexual-health information, and information that permits health-related inferences.
