2 REQUIRED LEGAL EXCEPTIONS & STATE LAW RIGHTS
Saconde’s policy is that all sales are final. However, certain federal, state, local, or international laws may require specific disclosures, remedies, cancellation rights, refund rights, or other consumer protections that cannot be waived by contract.
To the fullest extent permitted by law, Saconde does not provide returns, refunds, exchanges, cancellations, store credits, price adjustments, or buyer’s remorse remedies. Where applicable law requires a refund, cancellation, replacement, repair, notice, or other remedy, Saconde will comply only to the minimum extent required by such applicable law.
Customers are responsible for reviewing this Policy before purchase. This Policy shall be posted or made available through Saconde’s website, invoices, checkout pages, receipts, showroom signage, point-of-sale areas, and/or other sales channels as applicable.
If any part of this Policy is deemed invalid, unenforceable, or limited by applicable law, the remaining portions shall remain in full force and effect.
3 CONSPICUOUS POSTING, DISCLOSURE & CUSTOMER ACKNOWLEDGMENT
Saconde’s return, refund, exchange, cancellation, shipping, delivery, authenticity, and final-sale policies shall be posted, displayed, linked, printed, or otherwise made available to customers as applicable through Saconde’s website, checkout pages, product pages, invoices, payment links, receipts, showroom signage, point-of-sale areas, order confirmations, and/or other sales channels.
By placing an order, submitting payment, accepting an invoice, completing checkout, purchasing in-store, purchasing through a third-party platform, or otherwise completing a transaction with Saconde, the customer acknowledges that they had an opportunity to review this Policy before purchase and agrees that the purchase is subject to this Policy.
For in-store purchases, Saconde may post a short-form final-sale notice at the point of sale, on receipts, on invoices, near merchandise, and/or in other conspicuous locations. For online, invoice, social media, payment-link, and remote purchases, Saconde may present or link this Policy before payment, during checkout, on the invoice, in order confirmation communications, and/or through platform terms.
If applicable law requires a particular method of disclosure, posting, acknowledgment, or customer notice that cannot be waived, Saconde will comply with such law to the extent required.
4 GIFT CARDS, STORE CREDIT & PROMOTIONAL CREDIT
Saconde may, in its discretion, issue or sell gift cards, gift certificates, store credits, promotional credits, discount codes, account credits, platform credits, courtesy credits, marketing credits, or similar value credits through its website, showroom, invoices, social media channels, third-party platforms, promotional campaigns, customer service communications, or any other sales or marketing channel.
Purchased Gift Cards and Purchased Store Credit.
Gift cards, gift certificates, or store credits purchased directly from Saconde for monetary value are subject to applicable federal, state, and local laws, including any legally required expiration, fee, disclosure, and cash-redemption rules. Purchased gift cards and purchased store credits are not redeemable for cash and are not refundable except where required by applicable law. Where applicable law requires Saconde to redeem a remaining balance for cash, Saconde will do so only to the extent required by law and only after verifying the applicable balance, transaction history, purchaser information, holder eligibility, and any fraud-prevention information.
Promotional Credits and Courtesy Credits.
Any gift card, gift certificate, store credit, account credit, discount, reward, voucher, code, or other credit issued by Saconde without full monetary consideration is considered a promotional credit or courtesy credit, not purchased cash value. This includes credits issued through social media promotions, influencer campaigns, customer service adjustments, giveaways, loyalty rewards, referral offers, marketing campaigns, goodwill gestures, abandoned-offer resolutions, rejected-item resolutions, platform credits, or any third-party marketplace or platform where Saconde participates.
Promotional credits are not redeemable for cash, are not refundable, are not transferable, may not be resold, and may be limited, revoked, modified, refused, or canceled by Saconde at any time to the fullest extent permitted by applicable law. Promotional credits may be subject to expiration dates, usage limits, product exclusions, minimum purchase requirements, account restrictions, identity verification, fraud review, and other terms stated at the time of issuance or otherwise provided by Saconde.
No Cash Value Unless Required by Law.
Except where required by applicable law, Saconde gift cards, store credits, promotional credits, discount codes, account credits, and similar credits have no cash value and may only be used toward eligible purchases from Saconde. Credits may not be applied to shipping, taxes, authentication fees, consignment fees, cancellation fees, counterfeit-item fees, return-shipping charges, repair costs, administrative fees, or other charges unless Saconde expressly agrees in writing.
Expiration, Fees, and State-Specific Rights.
Saconde will comply with applicable gift card and store-credit laws, including New York law for purchased gift cards and gift certificates. For example, New York generally requires covered gift cards or gift certificates purchased on or after December 10, 2022, to remain valid for at least nine years and permits cash redemption when the remaining balance is less than five dollars, subject to legal exceptions. Promotional gift certificates issued without consideration are treated differently under New York law.
Federal gift card rules also restrict expiration dates and certain dormancy, inactivity, and service fees for covered gift certificates, store gift cards, and general-use prepaid cards. These rules generally require clear disclosures and limit expiration of underlying funds to at least five years, subject to exceptions and applicable law.
Fraud, Abuse, and Error Correction.
Saconde reserves the right to refuse, suspend, cancel, void, or investigate any gift card, store credit, promotional credit, discount code, or account credit if Saconde suspects fraud, abuse, unauthorized resale, chargeback abuse, duplicate issuance, system error, violation of Saconde policies, or misuse. Saconde may require proof of purchase, identity verification, account verification, original payment records, or other documentation before honoring or cashing out any credit.
No Conflict With Final Sale Policy.
Issuance or use of any gift card, store credit, promotional credit, discount code, or similar credit does not create a right to return, refund, exchange, cancel, or dispute a final-sale purchase. All Saconde purchases remain final sale except where otherwise required by applicable law or expressly agreed by Saconde in writing.
5 AUTHENTICITY CLAIM REQUIREMENTS
Saconde takes authenticity seriously and implements internal and third-party authentication procedures where deemed appropriate.
Any authenticity claim, dispute, or review request must satisfy ALL of the following conditions:
- The original Saconde authentication/security tag must remain fully attached to the item;
- The tag must be untampered with, unaltered, undamaged, and in its original condition;
- The item must remain unused and in the exact condition in which it was delivered;
- All original packaging, accessories, certificates, receipts, and inclusions must accompany the item.
If the authentication/security tag is:
- removed,
- cut,
- detached,
- altered,
- replaced,
- tampered with,
- damaged, or
- otherwise compromised,
then the item shall be conclusively deemed authentic, genuine, accepted by the purchaser, and non-disputable.
Removal or tampering with the authentication tag immediately voids:
- any authenticity claim,
- any return request,
- any refund request,
- any chargeback claim related to authenticity,
- and any buyer protection request to the fullest extent permitted by law.
6 LEGAL COMPLIANCE, COUNTERFEIT CLAIMS & PROHIBITED TRANSACTIONS
Saconde reserves the right to refuse, cancel, hold, investigate, report, or decline any transaction, return request, authenticity claim, shipment, payout, or release of goods if Saconde suspects counterfeit goods, stolen goods, fraud, unlawful activity, sanctions issues, prohibited resale activity, payment abuse, identity misuse, or violation of applicable law or platform rules.
Saconde may cooperate with law enforcement, customs authorities, payment processors, financial institutions, authentication providers, marketplace platforms, brand-protection representatives, and other relevant parties where Saconde determines such cooperation is appropriate or required.
Nothing in this Policy requires Saconde to ship, return, release, refund, or transfer any item or funds where doing so may violate applicable law, platform rules, fraud-prevention requirements, chargeback rules, customs rules, or brand-protection procedures.
7 CLAIM REVIEW PROCEDURE; PROOF OF PURCHASE REQUIRED
Any refund request, authenticity claim, delivery claim, chargeback response, legal compliance review, or other customer claim must be submitted with sufficient proof of purchase and supporting documentation. Saconde may require, as applicable:
- Original receipt, invoice, order number, or transaction confirmation;
- Customer identification and contact information;
- Photos or videos of the item, packaging, shipping label, authentication/security tag, and any claimed issue;
- All original packaging, accessories, certificates, cards, receipts, dust bags, boxes, straps, locks, keys, tags, and inclusions;
- Written explanation of the claim;
- Carrier documentation, police report, affidavit, customs notice, or other third-party documentation where applicable.
Failure to provide requested documentation, preserve the item and packaging, cooperate with Saconde’s review, or submit the claim within any legally required or Saconde-designated timeframe may result in denial of the claim to the fullest extent permitted by law.
Saconde’s review of any claim does not waive Saconde’s final-sale policy and does not guarantee a refund, return, exchange, cancellation, credit, or other remedy.
8 PRE-OWNED & VINTAGE ITEMS
(a) NON-RETURNABLE AND HIGH-RISK ITEMS
Without limiting Saconde’s final-sale policy, the following categories of items are non-returnable, non-refundable, non-exchangeable, and not eligible for cancellation to the fullest extent permitted by law:
- Pre-owned, vintage, collectible, consignment, rare, discontinued, limited-edition, or previously handled items;
- Luxury handbags, accessories, jewelry, watches, apparel, footwear, and similar personal goods;
- Items sold with authentication/security tags;
- Items where the authentication/security tag has been removed, cut, altered, damaged, tampered with, or detached;
- Items that have been used, worn, altered, repaired, cleaned, resized, damaged, scented, stained, or modified after purchase;
- Items missing packaging, dust bags, boxes, tags, straps, locks, keys, certificates, cards, receipts, accessories, or other inclusions;
- Special orders, pre-orders, sourced items, marketplace purchases, and items purchased through invoices or payment links;
- International orders;
- Items purchased using promotional credit, discount codes, courtesy credits, or other non-cash promotional value.
Nothing in this section limits any non-waivable rights that may apply under applicable law.
Many items sold by Saconde are pre-owned, vintage, consignment, collectible, or previously handled luxury goods and may show signs of age, wear, storage, use, repairs, modifications, or imperfections.
Minor imperfections, wear, scent, discoloration, creasing, scratches, hardware wear, or other characteristics consistent with pre-owned luxury goods shall not constitute:
- misrepresentation,
- damage,
- counterfeit evidence,
- or grounds for dispute.
All buyers are responsible for carefully reviewing:
- photos,
- descriptions,
- measurements,
- condition notes,
- and item specifications
prior to purchase.
(b) PRODUCT DESCRIPTIONS, PHOTOS, MEASUREMENTS & LISTING ERRORS
Saconde makes reasonable efforts to describe and photograph items accurately. However, because many items are pre-owned, vintage, consignment, collectible, rare, handmade, repaired, altered, or previously handled, descriptions, colors, measurements, condition ratings, dates, materials, model names, hardware tones, and other details may be approximate.
Photos may be affected by lighting, screen settings, shadows, camera angles, reflections, editing, compression, or display differences. Measurements are approximate and may vary.
Typographical errors, pricing errors, inventory errors, listing mistakes, description errors, image errors, availability errors, and other clerical or technical errors do not create a binding obligation by Saconde. Saconde reserves the right to correct errors, cancel orders, refuse transactions, or modify listings before shipment or fulfillment, subject to applicable law.
Customers are responsible for reviewing all photos, descriptions, condition notes, measurements, and item details before purchase and for asking any questions before completing a transaction.
9 NO WARRANTIES
To the fullest extent permitted under applicable law, Saconde disclaims all express and implied warranties, including but not limited to:
- merchantability,
- fitness for a particular purpose,
- non-infringement,
- and implied warranties arising from course of dealing or usage of trade.
No employee, representative, contractor, or agent may modify this policy unless expressly authorized in writing by Saconde.
10 CHARGEBACK & PAYMENT DISPUTE POLICY
(a) PAYMENT PROCESSING, FRAUD REVIEW & ORDER VERIFICATION
Saconde may require additional verification before accepting, processing, shipping, releasing, or completing any order. Verification may include identity verification, payment verification, billing address confirmation, shipping address confirmation, fraud screening, telephone or email confirmation, signature confirmation, or additional documentation.
Saconde may cancel, delay, refuse, or hold any order if Saconde suspects fraud, unauthorized payment, chargeback risk, identity mismatch, suspicious activity, resale abuse, sanctions risk, export restriction issues, or violation of Saconde policies.
Use of a payment method does not guarantee order acceptance. An order is not final until accepted and fulfilled by Saconde.
(b)
By completing a purchase, the customer agrees not to initiate improper chargebacks or payment disputes for:
- disclosed item condition,
- sizing,
- fit,
- wear,
- buyer’s remorse,
- delayed carrier scans,
- market value fluctuations,
- or claims barred by this policy.
Saconde reserves the right to:
- contest chargebacks with supporting evidence,
- provide order records, photographs, tracking information, authentication records, IP logs, signatures, communications, and fraud-prevention data,
- recover collection costs, attorney’s fees, administrative expenses, and damages where permitted by law.
Fraudulent chargebacks may be reported to:
- Payment processors,
- Financial institutions,
- Fraud databases,
- Collections agencies,
- Law enforcement authorities
11 SHIPPING, DELIVERY, REFUSED DELIVERIES & INTERNATIONAL ORDERS
Shipping Times and Availability
Shipping times, processing times, delivery estimates, and carrier timelines are estimates only and are not guaranteed unless expressly stated in writing by Saconde. Saconde may delay shipment for authentication review, fraud review, payment verification, address verification, weather events, carrier disruptions, customs review, operational delays, inventory discrepancies, or other circumstances.
For online, phone, invoice, mail, or other remote orders, Saconde will comply with applicable shipping-delay laws, including any legally required notices, cancellation rights, or refunds for unshipped merchandise where required by law.
Saconde reserves the right to cancel any order before shipment if the item is unavailable, incorrectly listed, incorrectly priced, flagged for fraud review, restricted from sale, restricted from shipment, or otherwise cannot be fulfilled. If Saconde cancels an order before shipment and payment has already been collected, Saconde will issue any refund required by applicable law.
Risk of Loss
Risk of loss transfers to the purchaser upon delivery to the shipping carrier or confirmed delivery to the destination address, to the fullest extent permitted by applicable law. Saconde is not responsible for packages that are lost, stolen, delayed, misdelivered, held, refused, abandoned, damaged in transit, seized, returned to sender, or otherwise affected after shipment, except where required by applicable law.
Customers are responsible for providing a complete, accurate, and deliverable shipping address at the time of purchase. Saconde is not responsible for delays, losses, additional charges, or failed deliveries caused by incorrect addresses, missing apartment or suite numbers, forwarding requests, mail holds, unavailable recipients, carrier access issues, customs delays, or customer failure to retrieve a package.
Signature, Insurance, and Delivery Confirmation
Saconde may, in its discretion, require signature confirmation, adult signature, insurance, identity verification, delivery restrictions, carrier hold-for-pickup, or other delivery safeguards for any order.
Refusal or failure to comply with carrier delivery requirements does not cancel the sale and does not entitle the customer to a refund, cancellation, chargeback, exchange, or store credit except where required by applicable law.
A carrier’s delivery confirmation, signature record, GPS scan, photo confirmation, pickup confirmation, tracking update, or similar delivery record may be used as proof of shipment, attempted delivery, pickup, or delivery.
In-Store Pickup and Customer Inspection
For in-store pickup, showroom pickup, courier pickup, or any local handoff, the customer or authorized pickup person is responsible for inspecting the item before accepting possession.
Once the item is accepted, picked up, released, or handed off, the sale is final to the fullest extent permitted by applicable law.
Saconde may require identification, order confirmation, signature, pickup authorization, photographs, surveillance confirmation, or other verification before releasing an item.
Release of an item to the customer, authorized representative, courier, delivery service, or other pickup person designated by the customer constitutes delivery to the customer to the fullest extent permitted by applicable law.
Refused Deliveries, Returned Packages, and Undeliverable Orders
If a customer refuses delivery, fails to accept delivery, fails to pick up a package, provides an incorrect or incomplete address, is unavailable for delivery, refuses to pay customs duties or import charges, or causes the package to be returned to Saconde for any reason, the sale remains final to the fullest extent permitted by applicable law.
Returned, refused, abandoned, or undeliverable packages may be subject to additional charges, including but not limited to:
- Original shipping charges;
- Return shipping charges;
- Re-shipping charges;
- Carrier fees;
- Insurance fees;
- Customs, duties, taxes, brokerage fees, or import/export charges;
- Storage, handling, administrative, or processing fees;
- Payment processing fees;
- Any loss in item value, damage, or missing packaging caused by transit, refusal, return, or customer delay.
Saconde may, in its discretion, reship the item only after the customer pays all applicable re-shipping, return, handling, administrative, customs, duty, tax, and carrier fees.
Saconde is not required to reship any item if Saconde determines that reshipment is commercially unreasonable, legally restricted, unsafe, or impractical.
If an item is returned to Saconde and the customer does not pay required fees or provide instructions within a reasonable time, Saconde may treat the package as abandoned to the fullest extent permitted by applicable law.
Lost, Stolen, Delayed, or Damaged Packages
Saconde is not responsible for carrier delays, lost packages, stolen packages, porch theft, misdelivery, weather delays, customs delays, routing errors, or damage caused by shipping carriers, except where required by applicable law.
Customers must promptly notify Saconde of any delivery issue. Saconde may require the customer to cooperate with carrier claims, provide photographs, police reports, affidavits, claim forms, packaging materials, written statements, or other documentation.
Failure to cooperate with a carrier claim, fraud review, insurance claim, or delivery investigation may result in denial of any claim, refund, replacement, exchange, cancellation, store credit, or other remedy to the fullest extent permitted by applicable law.
International Orders
International orders are final sale. International customers are solely responsible for confirming that the purchased item may be lawfully imported into the destination country and for paying all applicable customs duties, tariffs, VAT, GST, import taxes, brokerage fees, carrier fees, clearance fees, storage fees, and other government or carrier charges.
Saconde is not responsible for customs delays, import restrictions, seizure, confiscation, destruction, refusal by customs authorities, unpaid duties or taxes, abandoned shipments, carrier holds, or delivery failures outside the United States.
Saconde will not understate item values, mark purchases as gifts, falsify customs declarations, alter invoices, misdescribe merchandise, or otherwise provide inaccurate customs documentation.
If an international package is returned, refused, seized, abandoned, destroyed, delayed, or rejected because of customs, unpaid duties, import restrictions, incorrect address information, customer refusal, or failure to retrieve the package, the customer remains responsible for all costs, losses, fees, taxes, duties, shipping charges, return charges, and administrative expenses to the fullest extent permitted by applicable law.
Taxes, Shipping Charges, Duties, and Fees
Shipping charges, delivery fees, insurance charges, authentication fees, processing fees, administrative fees, payment processing fees, customs duties, import taxes, VAT, GST, brokerage fees, carrier fees, and similar charges are non-refundable except where required by applicable law or expressly agreed by Saconde in writing.
If any tax, duty, fee, or charge is collected or imposed by a government, carrier, payment processor, marketplace, customs authority, or third party, Saconde is not responsible for refunding such amount unless required by applicable law.
Remote Orders
For remote orders, including website, invoice, phone, mail, social media, and payment-link orders, Saconde will make commercially reasonable efforts to ship within the stated shipping timeframe.
If no specific shipment timeframe is stated, Saconde will follow applicable law regarding shipment timing for remote orders.
If Saconde is unable to ship within the stated or legally required timeframe, Saconde may provide any legally required delay notice, request customer consent to the delay, cancel the order, or issue a refund for unshipped merchandise where required by applicable law.
12 LIMITATION OF LIABILITY
To the maximum extent permitted by law, Saconde shall not be liable for any:
- Indirect damages,
- Incidental damages,
- Consequential damages,
- Loss of profits,
- Loss of business opportunity,
- Emotional distress,
- Reputational harm,
- Punitive damages
arising from any purchase or use of products sold.
In all circumstances, Saconde’s maximum liability shall not exceed the purchase price actually paid for the item giving rise to the claim.
13 DISPUTE RESOLUTION; CLASS ACTION AND JURY TRIAL WAIVER
To the fullest extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to a purchase from Saconde, this Policy, or any related transaction shall be brought only on an individual basis and not as a plaintiff, class member, or representative in any purported class, collective, consolidated, private attorney general, or representative proceeding.
To the fullest extent permitted by applicable law, the parties waive any right to a jury trial in any dispute arising out of or relating to a purchase from Saconde, this Policy, or any related transaction.
If any portion of this section is found unenforceable, the remaining portions of this Policy shall remain in effect to the fullest extent permitted by law.
14 PLATFORM, MARKETPLACE & THIRD-PARTY SALES
This policy and all transactions shall be governed by the laws of the State of New York, without regard to conflict of law principles.
This Policy applies to purchases made through Saconde’s website, showroom, invoices, social media channels, live-selling platforms, third-party marketplaces, payment links, messaging applications, and any other sales channel unless a separate written policy is expressly provided by Saconde.
If a third-party platform, marketplace, payment processor, or sales channel imposes mandatory rules that cannot be waived, Saconde will comply only to the extent required by that platform or applicable law. Otherwise, Saconde’s final-sale policy, authenticity tag requirements, shipping rules, chargeback policy, and other terms apply to the fullest extent permitted by law.
Customers are responsible for reviewing both Saconde’s policies and any applicable third-party platform policies before purchase.
15 GOVERNING LAW & VENUE
Any dispute arising from purchases made through Saconde shall be resolved exclusively in the state or federal courts located in New York County, New York, to the fullest extent permitted by law.
16 RIGHT TO REFUSE SERVICE
Saconde reserves the right to:
- Refuse service,
- Cancel transactions,
- Limit quantities,
- Refuse returns,
- Refuse future purchases,
- Deny transactions
to any individual or entity for suspected fraud, abuse, resale misconduct, or violations of company policies.
17 EFFECTIVE DATE; POLICY UPDATES
This Policy is effective as of May 25, 2026. Saconde may update, modify, or replace this Policy at any time. The version of the Policy in effect at the time of purchase will generally apply to that purchase, except where a later update is required by applicable law or expressly agreed by Saconde in writing.
Customers are encouraged to review this Policy before each purchase.
By completing your purchase, you acknowledge and agree to these terms.
