1. Acceptance of Terms
By accessing, browsing, or purchasing from Saconde & Saconde, LLC ("Company," "we," "us," or "our"), whether online or in-store, you ("Customer," "you") agree to be bound by these Terms & Conditions ("Terms").
These Terms apply to all transactions conducted within the United States, including all 50 states.
2. Business Description
Saconde & Saconde, LLC is a luxury goods retailer specializing in:

Items may be:
- New
- Pre-owned
- Consigned
All items are sold under the policies outlined herein.
3. All Sales Are Final (No Returns / No Refunds / No Exchanges)
ALL SALES ARE FINAL.
- No returns
- No refunds
- No exchanges
This applies to:
- Online purchases
- In-store purchases
- Invoice or remote transactions
By completing a purchase, you acknowledge and agree to this Final Sale Policy.
4. Required Legal Exceptions
Nothing in these Terms limits rights granted under applicable law.
In compliance with U.S. federal law and state consumer protection statutes, including those of New York and California:
We will provide remedies where required by law, including if:
- An item is materially defective
- An item is not as described
- Fraud or misrepresentation is proven
Any such claims are strictly limited to legal requirements and must comply with Section 6 (Authentication Policy).
5. Authentication Policy
All items sold by Saconde & Saconde, LLC undergo an authentication process using internal expertise and/or third-party verification.
Authentication Tag Requirement
Each item may include an authentication tag.
STRICT POLICY:
- Authentication tags must remain attached and unaltered
If the tag is:
- Removed
- Cut
- Tampered with
Then:
- The item is deemed accepted as authentic and final
- All authentication-related claims are permanently waived and void
No exceptions.
6. Claims & Disputes Regarding Authenticity
To make any claim regarding authenticity:
- The item must be in original condition
- The authentication tag must remain intact
- Claim must be submitted within 48 hours of delivery or in-store purchase
Failure to meet these conditions voids all claims.
7. Condition & Product Disclosure
Many items are pre-owned and may show signs of wear.
We strive for accuracy but do not guarantee:
- Exhaustive condition descriptions
- Identification of all minor imperfections
By purchasing, you agree:
- You have reviewed all available information
- You accept the item as-is
8. Pricing & Payment Terms
- All prices are in USD
- Applicable sales tax is added based on destination state
We reserve the right to:
- Correct pricing errors
- Cancel orders due to inaccuracies
Accepted payment methods may include:
- Credit/debit cards
- Wire transfers
- Approved financing providers
9. Shipping, Delivery & Risk of Loss
Online Orders: Risk of loss transfers upon shipment.
In-Store Purchases: Risk transfers upon physical delivery.
We are not liable for:
- Carrier delays
- Lost, stolen, or damaged packages after confirmed delivery
Signature confirmation may be required.
10. Title Transfer
Ownership transfers upon:
- Full payment
- Delivery or shipment of the item
11. Chargebacks & Payment Disputes
You agree not to initiate chargebacks without first contacting us.
Improper chargebacks may result in:
- Legal action
- Collection efforts
- Blacklisting from future purchases
We reserve the right to provide all transaction records to financial institutions.
12. Limitation of Liability
To the fullest extent permitted by law:
Saconde & Saconde, LLC shall not be liable for:
- Indirect damages
- Incidental damages
- Consequential damages
Maximum liability is limited to the purchase price of the item.
13. Disclaimer of Warranties
All products are sold: "AS IS" and "AS AVAILABLE"
We disclaim all implied warranties, including:
- Merchantability
- Fitness for a particular purpose
Except where prohibited by law.
14. Indemnification
You agree to indemnify and hold harmless Saconde & Saconde, LLC from:
- Claims arising from misuse of products
- Violation of these Terms
- Fraudulent or unlawful activity

These Terms are drafted to comply with:

16. Dispute Resolution & Arbitration
Binding Arbitration
All disputes shall be resolved through binding arbitration on an individual basis.

These Terms are governed by the laws of the State of New York.
17. Force Majeure
We are not responsible for delays or failure due to:
- Natural disasters
- Government actions
- Supply chain disruptions
- Labor disputes

Your use of our services is also governed by our Privacy Policy.
19. Biometric Information, Facial Recognition & Identity Verification
This section discloses our practices regarding the collection, use, storage, and destruction of biometric information in connection with our services. By using our services, visiting our premises, or engaging in identity verification, you acknowledge and agree to the practices described herein.
a. Definitions
For purposes of this section:
- "Biometric Information" means any information based on an individual's biometric identifier used to identify an individual, including but not limited to a retina or iris scan, fingerprint, voiceprint, scan of hand or face geometry, facial recognition data, or any other biological characteristic that can be used to identify an individual
- "Biometric Identifier" means a physiological or biological characteristic used for automated recognition of an individual, including but not limited to a fingerprint, voiceprint, retina or iris image, or a unique biological pattern or characteristic
- "Identity Verification" means any process used to confirm the identity of an individual, including but not limited to government-issued photo identification review, facial recognition comparison, selfie-based verification, and document authentication
b. Collection of Biometric Information
Saconde & Saconde, LLC may collect, capture, or otherwise obtain biometric information and biometric identifiers from customers, sellers, visitors, and other individuals in the following circumstances:
- When you submit a government-issued photo identification for verification purposes
- When you complete a selfie-based or facial recognition identity verification process
- When you participate in an in-store check-in or appointment verification
- When you engage in a high-value transaction requiring enhanced identity verification
- When you sell, consign, or submit items and are required to verify your identity
- Through security cameras or surveillance systems that may utilize facial recognition or detection technology at our physical locations
- Through any third-party identity verification service integrated with our platform
c. Purpose of Collection
We collect and use biometric information for the following purposes:
- To verify the identity of customers, sellers, and visitors
- To prevent fraud, counterfeiting, and unauthorized transactions
- To comply with legal and regulatory requirements, including anti-money laundering (AML) and know-your-customer (KYC) obligations
- To protect the safety and security of our employees, customers, and premises
- To facilitate in-store check-in and appointment verification
- To authenticate individuals involved in high-value transactions
- To detect and prevent theft, shoplifting, and other criminal activity
- To maintain records necessary for legal compliance and dispute resolution
d. Consent
By engaging in any activity that involves the collection of biometric information, including but not limited to completing an identity verification process, visiting our physical locations, or submitting identification documents, you provide your informed written consent to the collection, use, storage, and disclosure of your biometric information as described in this section.
If you do not consent to the collection of biometric information, you may be unable to:
- Complete certain transactions
- Sell or consign items with us
- Enter our physical premises
- Access certain services or features
Your consent remains in effect until you provide written revocation to Saconde & Saconde, LLC, or until we no longer have a need to retain your biometric information, whichever occurs first.
e. Third-Party Processing
We may use third-party service providers to collect, process, store, or analyze biometric information on our behalf. These providers may include but are not limited to:
- Stripe Identity (for identity verification and document authentication)
- Security and surveillance system providers
- Authentication technology providers
- Cloud storage and infrastructure providers
Third-party providers are contractually required to comply with applicable biometric privacy laws and to maintain the confidentiality and security of biometric information.
By consenting to the collection of biometric information by Saconde & Saconde, LLC, you also consent to the transfer and processing of such information by our authorized third-party service providers.
f. Retention and Destruction
Saconde & Saconde, LLC will retain biometric information only for as long as necessary to fulfill the purposes for which it was collected, or as required by law, whichever is longer.
Unless otherwise required by law, biometric information will be permanently destroyed when:
- The initial purpose for collecting the information has been satisfied
- Three (3) years have elapsed from the date of the individual's last interaction with us, whichever occurs first
Destruction of biometric information shall be carried out in a manner that renders the data permanently unreadable and unrecoverable.
Notwithstanding the foregoing, we may retain biometric information beyond the standard retention period where:
- Required by applicable law, regulation, or court order
- Necessary for ongoing fraud investigations or legal proceedings
- Required for compliance with law enforcement requests
g. Disclosure
We will not sell, lease, trade, or otherwise profit from biometric information.
We may disclose biometric information only in the following circumstances:
- To third-party service providers who assist in identity verification, fraud prevention, security, or legal compliance, subject to contractual obligations of confidentiality
- When required by law, regulation, subpoena, court order, or legal process
- To law enforcement agencies in connection with criminal investigations or suspected illegal activity
- With your explicit consent
- To protect the rights, property, or safety of Saconde & Saconde, LLC, its employees, customers, or the public
h. Your Rights
Depending on your state of residence, you may have the following rights regarding your biometric information:
- The right to be informed about the collection and use of your biometric information
- The right to request access to your biometric information
- The right to request deletion or destruction of your biometric information, subject to legal exceptions
- The right to revoke consent to future collection of biometric information
- The right to bring a private action for violations of applicable biometric privacy laws, where permitted by statute

We will respond to valid requests within the timeframes required by applicable law. We may verify your identity before fulfilling any request.
This section is intended to comply with all applicable biometric privacy laws, including but not limited to the Illinois Biometric Information Privacy Act (BIPA), the Texas Capture or Use of Biometric Identifier Act, the Washington Biometric Identifier Law, the New York City Biometric Identifier Information Law, and any other state or local biometric privacy statutes that may apply.
20. Payment Processing & Third-Party Services
We use Stripe as our third-party payment processor to facilitate:
- Customer payments for purchases
- Payments to individuals or entities from whom we purchase goods
a. Third-Party Processor
By engaging in any transaction with Saconde & Saconde, LLC, you acknowledge and agree that:
- Payment processing services are provided by Stripe and are subject to Stripe's Terms of Service and Stripe's Privacy Policy
- You may be required to agree to Stripe's terms separately
b. Authorization
You authorize Saconde & Saconde, LLC and Stripe to:
- Charge your provided payment method for purchases
- Process, hold, and transfer funds as necessary to complete transactions
c. Seller Payments (If Applicable)
If you sell items to us or receive payment from us:
- Payments may be issued via Stripe or a Stripe-powered payout system
- You may be required to provide identity verification and tax information (e.g., SSN or EIN)
- Failure to provide required information may result in delayed or withheld payments
d. Payment Delays, Holds, and Freezes
We are not responsible for any delays, holds, account suspensions, or fund restrictions imposed by Stripe or financial institutions.
e. Fees & Deductions
We reserve the right to:
- Deduct applicable fees, commissions, or adjustments prior to issuing payment
- Offset amounts owed to us against payouts
f. Compliance & Reporting
We may be required to report transactions to tax authorities, including issuing forms such as Form 1099 where applicable.
g. Limitation of Liability
To the fullest extent permitted by law: Saconde & Saconde, LLC shall not be liable for any errors, interruptions, or security breaches caused by Stripe or any third-party payment provider.
h. 1099 / Tax Reporting Add-On
Users who receive payments from Saconde & Saconde, LLC may be subject to IRS reporting requirements. We reserve the right to collect taxpayer identification information and issue Form 1099s in compliance with applicable law.
21. Buyout & Consignment Offers; Authentication; Right of Rejection
a. Conditional Nature of Offers
All buyout offers (offers to purchase items from you) and consignment acceptances made by Saconde & Saconde, LLC are strictly conditional and subject to:
- Physical inspection
- Authentication
- Condition verification
Any preliminary quote, estimate, or offer (whether verbal, written, or digital) is non-binding until full verification is completed.
b. Authentication & Verification Process
All items submitted to us for buyout or consignment are subject to authentication using:
- Internal expertise
- Third-party authentication services, including but not limited to applications such as Entrupy or similar tools
We reserve sole and absolute discretion in determining authenticity and condition.
c. Right to Reject Items
We reserve the right to reject any item for any reason, including but not limited to:
- Failure to meet authenticity standards
- Condition issues
- Brand or market considerations
Rejected items will be returned to the sender at the sender's expense, unless otherwise agreed in writing.
d. Counterfeit or Inauthentic Items
If an item is determined, in our sole discretion, to be counterfeit, replica, inauthentic, or misrepresented, then:
- Any buyout offer or consignment agreement is immediately void and unenforceable
- The item will not be accepted for sale or consignment
- The sender is fully responsible for all return shipping costs, including insured shipping where applicable
We reserve the right to:
- Refuse future transactions
- Report suspected counterfeit activity to relevant authorities or third parties
e. Shipping Risk & Responsibility
When sending items to us:
- You assume all risk of loss or damage until the item is received and accepted by us
- We are not responsible for items lost, stolen, or damaged in transit
Return shipments (if applicable) will be:
- At your cost (especially in cases of rejection or failed authentication)
- Sent using a carrier and service level determined by us unless otherwise agreed
f. No Obligation to Purchase or Consign
Submission of an item does not obligate Saconde & Saconde, LLC to:
- Purchase the item
- Accept the item for consignment
All decisions are made at our sole discretion.
22. Modifications to Terms
We reserve the right to update these Terms at any time. Continued use of our services constitutes acceptance of revised Terms.
