1. PURPOSE AND SCOPE

This Account Deletion and Data Deletion Policy explains how Saconde & Saconde, LLC (“Saconde,” “Company,” “we,” “us,” or “our”) handles requests to:

  1. close, deactivate, or delete a Saconde account;
  2. delete personal information associated with an account;
  3. delete personal information when the individual does not have a Saconde account;
  4. withdraw consent to certain processing activities;
  5. delete photographs, videos, authentication materials, communications, or other content submitted to Saconde; and
  6. exercise deletion rights available under applicable federal, state, or local privacy laws.

This Policy applies to personal information collected through or in connection with:

This Policy is intended to apply throughout the United States. The rights available to a particular person may depend on the person’s state of residence, the nature of the information, Saconde’s relationship with the person, and whether a particular law applies to Saconde or the relevant processing activity.

This Policy supplements Saconde’s Privacy Policy, Terms and Conditions, Buyer Terms or Terms of Sale, Seller Terms and Conditions, Payment and Payout Terms, and other applicable agreements. If another applicable policy provides greater rights or protections, the more protective provision will apply to the extent required by law.

2. ACCOUNT DELETION AND DATA DELETION ARE DIFFERENT

Deleting a Saconde account and deleting personal information are related but distinct actions.

2.1 Account deletion

Account deletion generally means that Saconde closes or disables the user’s ability to access and use the account. Following account deletion:

Deleting an account does not necessarily require Saconde to delete every record connected with that account.

2.2 Data deletion

Data deletion means deleting, de-identifying, aggregating, anonymizing, or otherwise rendering personal information no longer reasonably linkable to the individual, subject to applicable law and the retention exceptions described in this Policy.

Saconde may retain certain information after an account is deleted when the information is reasonably necessary for legal compliance, transaction records, fraud prevention, security, disputes, tax and accounting obligations, enforcement of agreements, protection of luxury goods, or other permitted purposes.

2.3 Marketing opt-out

Deleting an account is not required to stop marketing communications. Users may separately:

Transactional, security, legal, payout, recall, fraud-prevention, and account-administration messages may still be sent when reasonably necessary or legally permitted.

3. HOW TO REQUEST ACCOUNT DELETION

A user may request deletion of a Saconde account through any deletion method Saconde makes available, which may include:

Where available, a user may submit a deletion request through the Saconde application by navigating to an account, privacy, security, or settings menu and selecting the available account-deletion option.

The location and wording of this feature may change as the application is updated.

A user may submit a request through any privacy-request or account-deletion form made available on www.saconde.com.

3.3 Email request

A user may email hello@saconde.com with the subject line:

The request should include sufficient information for Saconde to identify the relevant account, such as:

Users should not send passwords, complete payment-card numbers, complete bank-account numbers, government identification numbers, or unnecessary copies of identification through ordinary email.

3.4 Requests made in person

A person may ask for assistance at Saconde’s retail/showroom location. Saconde personnel may provide instructions or direct the person to an electronic request method. For security and recordkeeping purposes, Saconde may require the request to be completed through an authenticated account, online form, or verified email process.

3.5 Requests by non-account holders

A person who does not have a Saconde account may request deletion of personal information by contacting hello@saconde.com and identifying the interaction, transaction, submission, communication, or other circumstances through which Saconde may have obtained the information.

4. WHAT HAPPENS AFTER AN ACCOUNT-DELETION REQUEST

After receiving a deletion request, Saconde may:

  1. acknowledge receipt of the request;
  2. ask the requester to verify their identity or authority;
  3. review the account for pending transactions, balances, disputes, investigations, or legal restrictions;
  4. provide information about the consequences of deletion;
  5. close or restrict the account;
  6. delete or de-identify eligible personal information;
  7. retain information covered by a legal or permitted retention exception;
  8. notify applicable service providers, contractors, or other recipients when required by law; and
  9. provide a response describing the action taken or the reason the request could not be fully completed.

Saconde may initially deactivate or restrict an account before permanently deleting eligible account information. This may be necessary to prevent unauthorized access, preserve transaction integrity, resolve pending activity, or allow deletion instructions to be processed across Saconde’s systems.

5. PENDING TRANSACTIONS AND OBLIGATIONS

Saconde may delay account deletion or preserve access to limited account functions while any of the following remains pending:

Submitting a deletion request does not cancel an order, rescind a sale, terminate a consignment, waive an amount owed, reverse a title transfer, eliminate a return obligation, or extinguish any rights or responsibilities arising before deletion.

6. IDENTITY VERIFICATION

To protect users and prevent fraudulent or unauthorized deletion, Saconde may verify the requester’s identity before completing a request.

Depending on the nature and sensitivity of the information, verification may include:

Saconde will request only the information reasonably necessary to verify the request. Information provided for verification will be used for verification, security, fraud prevention, recordkeeping, and legal compliance.

Saconde may deny or limit a request if it cannot reasonably verify the requester’s identity or authority.

7. AUTHORIZED AGENTS

Where applicable law permits, a consumer may authorize another person to submit a request on the consumer’s behalf.

Saconde may require:

Subject to verification, technical feasibility, and legal exceptions, information eligible for deletion may include:

Deletion of an account does not require Saconde to delete accurate records showing:

11. PHOTOGRAPHS, VIDEOS, AUTHENTICATION MATERIALS, AND ITEM RECORDS

A deletion request may include photographs, videos, receipts, serial numbers, date codes, product identifiers, authenticity documents, ownership materials, or other item-related content.

Saconde may retain some or all of these materials when reasonably necessary to:

When deletion is required but complete deletion of an item record is not permitted or reasonably possible, Saconde may remove or obscure unnecessary identifiers while retaining the portions of the record required for permitted purposes.

Deletion of biometric login credentials stored locally on a user’s device is generally controlled through the device’s operating system. Saconde generally does not receive the underlying fingerprint, facial template, or other biometric credential used by Apple, Android, or another device provider to authenticate the user, unless expressly disclosed in a separate biometric notice.

13. THIRD-PARTY SERVICE PROVIDERS AND RECIPIENTS

14. BACKUPS, ARCHIVES, AND TECHNICAL LIMITATIONS

Personal information may remain temporarily in encrypted backups, disaster-recovery systems, archives, logs, or other systems that are not used for ordinary business operations.

Where immediate deletion from a backup is not reasonably possible, Saconde may:

15. RESPONSE TIMES

Saconde will respond within the period required by applicable law.

Depending on the applicable law, Saconde generally will respond within approximately 45 days after receiving a verifiable request. Saconde may extend the response period when reasonably necessary and legally permitted based on the complexity or number of requests. When an extension is used, Saconde will provide notice as required by law.

The response period may not begin until Saconde receives the information reasonably needed to verify the requester’s identity or authority.

Requests involving backups, archived information, complex seller or consignment transactions, fraud investigations, legal holds, or multiple systems may require additional processing time where permitted by law.

16. FEES AND REPETITIVE REQUESTS

Saconde generally will not charge a fee for a valid deletion request.

To the extent permitted by law, Saconde may charge a reasonable fee or deny a request that is:

If an appeal is denied, Saconde will provide any information required by applicable law regarding how the requester may contact the appropriate state attorney general or regulatory authority.

19. RECREATING AN ACCOUNT AFTER DELETION

A former user may be permitted to create a new Saconde account after deletion, but Saconde does not guarantee that:

Saconde may refuse or restrict a new account where permitted by law, including when necessary to prevent fraud, enforce prior restrictions, protect users, or comply with legal obligations.

20. EFFECT ON STORE CREDIT, GIFT CARDS, REWARDS, AND PROMOTIONS

Before requesting account deletion, users should review any:

Account deletion does not eliminate rights in purchased gift cards or other property that cannot legally be forfeited. However, the user may need to provide sufficient proof of ownership to access or use a balance after the account is deleted.

Promotional credits, rewards, referral benefits, and similar discretionary benefits may expire, be cancelled, or become unavailable upon account deletion in accordance with the applicable program terms and law.

21. CHILDREN’S INFORMATION

Saconde’s Services are not directed to children under 13, and Saconde does not knowingly collect personal information online from children under 13 without legally required parental consent.

A parent or legal guardian who believes that a child has provided personal information to Saconde may contact hello@saconde.com and request review and deletion.

Saconde may take reasonable steps to verify:

Saconde will delete eligible children’s information as required by the Children’s Online Privacy Protection Act and other applicable laws, subject to legally permitted retention.

For teenagers and minors covered by applicable state privacy laws, Saconde will provide deletion and consent-withdrawal rights as required by those laws.

22. CONSUMER HEALTH DATA

Saconde does not intend to collect health information for diagnosis, treatment, insurance, or healthcare purposes.

However, certain information voluntarily provided by a user—such as accessibility needs, measurements, mobility information, or communications that could reveal health-related information—may be treated as consumer health data under certain state laws.

Where an applicable consumer health privacy law applies, a consumer may request deletion of covered consumer health data. Saconde will process the request in accordance with applicable law, which may require deletion from active systems and notification to relevant affiliates, processors, service providers, or other recipients.

Deletion from archived or backup systems may be delayed for the period expressly allowed by applicable law, provided the information is not used for another purpose during that period.

23. STATE PRIVACY RIGHTS

Depending on the requester’s state of residence and whether the applicable law applies to Saconde or the relevant processing, residents may have the right to:

These rights may arise under comprehensive or specialized privacy laws in states including California, Colorado, Connecticut, Delaware, Florida, Iowa, Indiana, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, Virginia, Washington, and other jurisdictions that adopt or amend applicable privacy laws.

Saconde will apply newly effective state privacy requirements to covered requests as required by law, even when a state is not expressly named in this Policy.

23.1 California residents

Subject to the California Consumer Privacy Act, as amended by the California Privacy Rights Act, eligible California residents may request deletion of personal information collected from or about them, subject to statutory exceptions.

Saconde may retain information when reasonably necessary for purposes permitted by California law, including completing transactions, security and integrity, debugging, legal compliance, exercising legal rights, and certain compatible internal uses.

California residents will not receive discriminatory treatment for exercising applicable privacy rights. However, deletion may affect features that require the deleted information.

23.2 Colorado, Connecticut, Delaware, Iowa, Indiana, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia residents

Where the relevant state privacy law applies, eligible residents may request deletion of personal data provided by or obtained about them, subject to applicable exceptions.

Residents may also have a right to appeal a denial. Appeal procedures are described in Section 18.

23.3 Washington and Nevada consumer health data

Where applicable, residents of Washington, Nevada, and other jurisdictions with consumer health privacy laws may request deletion of covered consumer health data, subject to applicable exceptions and backup-deletion periods.

23.4 Other states

Residents of states not specifically listed retain all rights available under applicable law. Saconde will not interpret the omission of a state from this Policy as limiting any legally available right.

24. NON-DISCRIMINATION

Saconde will not unlawfully discriminate against an individual for exercising an applicable privacy right.

Saconde will not, solely because a person submitted a lawful deletion request:

except where a difference is reasonably related to the value of the information, necessary because the requested service requires the information, part of a lawful loyalty or incentive program, or otherwise permitted by law.

Certain account features cannot function without necessary information. For example, Saconde may be unable to maintain an account, ship an order, issue a payout, authenticate access, or preserve a wish list after the relevant information has been deleted.

25. DATA RETENTION

Saconde retains personal information only for as long as reasonably necessary and proportionate for the purposes for which it was collected or another permitted purpose, including:

26. SECURITY OF DELETION REQUESTS

Saconde uses reasonable administrative, technical, and physical safeguards designed to protect deletion requests and the information used to verify them.

No storage, transmission, or deletion process can be guaranteed to be completely secure. Users are responsible for protecting account credentials and promptly notifying Saconde of suspected unauthorized access.

Saconde will not complete a deletion request solely based on an unverified communication when doing so could expose the account or information to unauthorized deletion.

27. APPLE APP STORE AND GOOGLE PLAY ACCOUNT-DELETION ACCESS

Where Saconde’s mobile application permits a user to create an account, Saconde will provide a reasonably accessible method for the user to initiate account deletion in accordance with applicable platform requirements.

Saconde may provide:

Removing or uninstalling the Saconde application from a device does not delete the user’s Saconde account or personal information. The user must submit a deletion request through one of the methods described in this Policy.

Deleting a Saconde account does not delete the user’s Apple ID, Google Account, payment-provider account, social-media account, or any other independently controlled third-party account.

28. CHANGES TO THIS POLICY

Saconde may update this Policy periodically to reflect:
