1. INTRODUCTION AND SCOPE

This Return, Shipping, Final Sale, and Authenticity Claim Policy (the “Policy”) governs purchases of merchandise from Saconde & Saconde, LLC (“Saconde,” “Company,” “we,” “us,” or “our”) through any Saconde-operated or authorized sales channel, including, as applicable:

Nothing in this Policy is intended to waive, disclaim, restrict, or limit any consumer right, warranty, remedy, cancellation right, refund right, or other protection that cannot lawfully be waived, disclaimed, restricted, or limited under applicable federal, state, or local law.

If this Policy conflicts with a mandatory provision of applicable law that cannot be waived by agreement, the mandatory provision of law will control solely to the extent of the conflict.

4. NEW YORK IN-STORE PURCHASES

Purchases made at Saconde's physical retail store, showroom, office, or other physical sales location in New York are final sale except where otherwise required by law.

Saconde will conspicuously post or otherwise disclose its refund policy in the manner required by applicable New York law. Customers should review the posted policy before completing a purchase.

Nothing in this section limits any remedy that a customer may have under applicable New York law that cannot legally be waived.

In-store customers are strongly encouraged to inspect merchandise before completing the transaction. Upon request and where reasonably practicable, customers may ask questions concerning an item's condition, measurements, accessories, provenance information available to Saconde, and other material characteristics before purchase.

Acceptance of merchandise after an opportunity for inspection does not waive any legal right that cannot lawfully be waived.

5. PRE-OWNED, VINTAGE, CONSIGNMENT, AND COLLECTIBLE MERCHANDISE

Many items sold by Saconde are pre-owned, vintage, consigned, collectible, rare, discontinued, previously handled, repaired, restored, altered, or otherwise not new.

Such merchandise may exhibit characteristics including:

Saconde makes commercially reasonable efforts to describe and photograph merchandise accurately. However, because many products are pre-owned, vintage, handmade, collectible, consigned, repaired, restored, altered, or previously handled:

A customer who believes that merchandise purchased from Saconde is not authentic should contact Saconde promptly at hello@saconde.com and provide sufficient information to permit a meaningful investigation.

To the fullest extent permitted by applicable law, Saconde may require:

10. AUTHENTICATION AND SECURITY TAGS

Certain Saconde merchandise may be delivered with an authentication tag, security tag, tamper-evident tag, seal, label, or other protective device.

Customers asserting an authenticity claim should preserve the tag fully attached and untampered with whenever reasonably possible.

Removal, cutting, detachment, alteration, replacement, damage, or tampering with a Saconde security or authentication tag may materially affect Saconde's ability to determine whether:

Accordingly, Saconde may consider tag removal or tampering as relevant evidence when evaluating a claim and may deny a voluntary return, courtesy accommodation, or contractual claim where the absence or alteration of the tag prevents reasonable verification.

However, removal, damage, or alteration of a security or authentication tag does not conclusively establish that an item is authentic and does not waive, eliminate, or restrict any non-waivable right or remedy available under applicable law.

Saconde may also deny a claim where credible evidence establishes item substitution, fraudulent alteration, intentional tampering, or other fraud, subject to applicable law.

11. RESOLUTION OF VALID AUTHENTICITY CLAIMS

If Saconde determines, or applicable law finally establishes, that an item sold by Saconde was counterfeit or materially misrepresented as authentic, Saconde will provide the remedy required by applicable law.

Depending on the circumstances and applicable law, this may include:

Saconde may require return or surrender of the merchandise where legally permitted. Saconde will not knowingly facilitate the unlawful trafficking, redistribution, or resale of counterfeit merchandise.

12. OTHER CUSTOMER CLAIMS

13. SHIPPING AND ORDER PROCESSING

Shipping and processing times are estimates unless Saconde expressly provides a legally binding guaranteed delivery date in writing.

Where the customer independently selects and contracts with a carrier not offered or arranged by Saconde, risk of loss may transfer upon delivery to that carrier to the extent permitted by applicable law.

Nothing in this Policy is intended to shift risk of loss to a consumer earlier than applicable law permits.

15. DELIVERY CONFIRMATION AND HIGH-VALUE ORDERS

Saconde may implement additional safeguards for high-value or higher-risk transactions, including:

To the extent permitted by law, Saconde is not responsible for losses, delays, or additional expenses caused by a customer's:

16. LOST, STOLEN, MISDELIVERED, DELAYED, OR DAMAGED PACKAGES

Customers should promptly notify Saconde of a lost, stolen, misdelivered, delayed, or damaged shipment.

For merchandise picked up at a Saconde store, showroom, office, event, or other physical location, Saconde may require:

18. REFUSED, RETURNED, AND UNDELIVERABLE PACKAGES

A customer's refusal of delivery, failure to retrieve a package, failure to satisfy reasonable carrier delivery requirements, or provision of an incorrect or incomplete shipping address does not automatically cancel a final-sale transaction except where applicable law provides otherwise.

To the fullest extent permitted by law, a customer whose acts or omissions cause merchandise to be returned to Saconde may be responsible for reasonable and actually incurred:

22. PROMOTIONAL AND COURTESY CREDITS

Credits issued without full monetary consideration—including promotional credits, courtesy credits, loyalty rewards, referral credits, giveaway credits, influencer promotions, discount codes, goodwill credits, and similar promotional value—may be subject to separate terms.

23. WARRANTIES AND NON-WAIVABLE RIGHTS

Except for warranties that cannot lawfully be excluded or disclaimed, and except for any express written warranty expressly provided by Saconde, merchandise is sold in its disclosed condition and, to the fullest extent permitted by applicable law, on an “AS IS” and “WITH ALL FAULTS” basis.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SACONDE DISCLAIMS IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Nothing in this section waives or limits a customer's rights under the Fair Credit Billing Act, Electronic Fund Transfer Act, applicable card-network rules, state law, or other applicable law.

26. COUNTERFEIT GOODS, STOLEN GOODS, FRAUD, AND ILLEGAL ACTIVITY

Saconde may refuse, cancel, hold, investigate, or report a transaction where it reasonably suspects:

27. THIRD-PARTY MARKETPLACES AND SALES CHANNELS

This Policy applies to purchases through Saconde-operated or authorized sales channels unless a separate policy expressly applies.

For purchases made through a third-party marketplace, live-selling platform, social-commerce platform, or other third-party sales channel, mandatory platform rules may also apply.

If a mandatory platform rule or applicable law provides a consumer right that cannot be waived by this Policy, that mandatory rule or law will control to the extent of the conflict.

Customers should review both Saconde's applicable policies and the governing terms of any third-party platform used to complete the transaction.

28. RIGHT TO REFUSE OR LIMIT TRANSACTIONS

Subject to applicable law, Saconde reserves the right to refuse service, limit quantities, cancel orders before fulfillment, require additional verification, or decline future transactions based on legitimate business, security, fraud-prevention, inventory, safety, legal, or compliance considerations.

Saconde will not exercise this right on a basis prohibited by applicable federal, state, or local anti-discrimination or consumer-protection law.

29. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SACONDE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM A PURCHASE OR USE OF MERCHANDISE.

To the fullest extent permitted by applicable law, Saconde's aggregate liability arising from a particular product transaction will not exceed the amount actually paid to Saconde for the merchandise giving rise to the claim.

However, these limitations do not apply to the extent prohibited by applicable law and do not exclude or limit liability that cannot lawfully be excluded or limited, which may include, depending on applicable law, liability for:

30. STATE-SPECIFIC AND NON-WAIVABLE CONSUMER RIGHTS

Nothing in this Policy is intended to waive, restrict, disclaim, or eliminate a right or remedy that cannot legally be waived under applicable federal, state, or local law.

The fact that a particular state-specific right is not individually identified in this Policy does not eliminate that right where applicable law makes it non-waivable.

For transactions subject to California law, nothing in this Policy waives any right or remedy that cannot lawfully be waived under applicable California consumer-protection law.

Any disclaimer of implied warranties, limitation of remedies, final-sale provision, or other contractual restriction applies to California consumers only to the extent enforceable under applicable law.

Saconde will also comply with applicable California requirements concerning gift certificates and gift cards, including cash-redemption requirements where applicable.

32. NEW YORK CONSUMERS

For transactions subject to New York law, Saconde will comply with applicable New York requirements governing the disclosure of refund policies for retail sales.

For purchases made at Saconde's New York physical retail location, Saconde will conspicuously post its refund policy as required by applicable law.

Nothing in this Policy limits a New York consumer's non-waivable rights concerning deceptive acts or practices, materially misrepresented goods, applicable warranties, gift cards, shipping, or other mandatory protections.

33. MASSACHUSETTS, CONNECTICUT, AND OTHER STATES WITH HEIGHTENED CONSUMER PROTECTIONS

Certain jurisdictions impose heightened restrictions on warranty disclaimers, limitations of remedies, consumer waivers, or unfair and deceptive business practices.

Any disclaimer, exclusion, limitation, final-sale provision, or waiver in this Policy applies only to the extent enforceable in the jurisdiction governing the particular transaction or claim.

Where applicable law prohibits or restricts a contractual provision, that provision will be interpreted and enforced only to the maximum extent lawfully permissible.

34. GOVERNING LAW

Except where applicable consumer-protection law requires otherwise, this Policy and transactions with Saconde will be governed by the laws of the State of New York, without regard to conflict-of-law principles.

However, this choice-of-law provision does not deprive a consumer of the protection of a mandatory law of the consumer's state of residence or another jurisdiction where such protection cannot lawfully be waived by contract.

35. DISPUTE RESOLUTION AND OTHER SACONDE TERMS

This Policy should be read together with Saconde's applicable:

Any arbitration agreement, jury-trial waiver, class-action waiver, governing-law provision, or dispute-resolution procedure applicable to a transaction should be governed by Saconde's applicable Terms of Use, Buyer Terms, Terms of Sale, or other controlling agreement rather than unnecessarily duplicated or inconsistently stated in this Policy.

If another Saconde agreement contains a valid dispute-resolution provision applicable to the transaction, that provision will govern according to its terms, subject to applicable law.

36. SEVERABILITY

If any provision of this Policy is determined to be invalid, illegal, or unenforceable in a particular jurisdiction or circumstance, that provision will be enforced to the maximum extent permitted by law and, where permitted, modified only to the minimum extent necessary to make it enforceable.

The invalidity or unenforceability of one provision will not affect the validity or enforceability of the remaining provisions, except where applicable law requires otherwise.

37. NO WAIVER

Saconde's failure to enforce a provision of this Policy on one occasion does not constitute a waiver of its right to enforce that provision or another provision in the future.

Any voluntary accommodation, courtesy refund, credit, exchange, claim review, or other exception granted by Saconde in a particular case does not create a continuing obligation or modify Saconde's general final-sale policy.

This section does not limit any right that cannot legally be waived.

38. POLICY UPDATES

Saconde may revise this Policy from time to time to reflect changes in:
