These Push Notification & Device Notification Terms (“Notification Terms”) govern the delivery and receipt of push notifications, web notifications, browser notifications, desktop notifications, mobile notifications, in-app alerts, device alerts, badges, sounds, banners, lock-screen notifications, notification-center messages, and similar electronic communications (collectively, “Notifications”) provided by or on behalf of Saconde & Saconde, LLC (“Saconde,” “Company,” “we,” “us,” or “our”).
These Notification Terms apply when you access, use, install, interact with, or enable Notifications through:
By enabling, authorizing, subscribing to, or otherwise consenting to receive Notifications from Saconde, you acknowledge that you have read and understood these Notification Terms.
Your use of Saconde's services may also be governed by our Privacy Policy, Terms and Conditions or Terms of Use, Seller Terms and Conditions, Buyer Terms, Cookie Policy, SMS/Text Message Terms, and any other applicable agreement, disclosure, or policy.

Permission granted to one browser, browser profile, device, website origin, or installed web application may not automatically apply to another.
For example, enabling Notifications in one browser may not automatically enable Notifications in another browser or on another device.
If Saconde offers an installable progressive web application or similar web-based application, Notifications may be delivered through the applicable browser, operating system, device, push service, or service-worker infrastructure.
Availability and functionality may vary by platform and device.
Saconde may support additional operating systems, browsers, devices, wearable devices, connected devices, or notification technologies in the future.
These Notification Terms apply to such technologies to the extent reasonably applicable.

You are responsible for verifying that you are interacting with an authentic Saconde application, website, or communication.
Saconde will never ask you to disclose your password, complete payment-card number, or other highly sensitive authentication credentials solely through a push Notification.
Fraudulent parties may attempt to impersonate Saconde through fake Notifications, applications, websites, emails, SMS messages, or other communications.
If you suspect that a Notification or communication is fraudulent, do not provide sensitive information or make payment through the suspicious communication. Instead, access Saconde directly through the official Saconde application or by manually navigating to the official Saconde website.
If you use a shared device, shared browser profile, shared operating-system account, shared user profile, or device accessible by others, other persons may be able to view your Notifications.
You are responsible for managing device access, account access, lock-screen settings, browser profiles, Notification previews, and other privacy settings.
Saconde's services are not directed to children under the minimum age specified in our Terms of Use or Privacy Policy.
We do not knowingly seek to send marketing Notifications directly to children in violation of applicable law.
Notification availability, functionality, consent requirements, and legal rights may vary by country, state, province, territory, platform, browser, operating system, and device.
If you access Saconde's services from outside the United States, additional local laws may apply.
Nothing in these Notification Terms limits rights that cannot lawfully be waived or restricted under applicable law.

Saconde does not control the independent terms, policies, systems, availability, or conduct of these third parties.
Saconde may suspend, limit, modify, or terminate any Notification service or category at any time, with or without notice, to the extent permitted by applicable law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NOTIFICATIONS AND NOTIFICATION SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
SACONDE DOES NOT WARRANT THAT NOTIFICATIONS WILL BE UNINTERRUPTED, ERROR-FREE, TIMELY, COMPLETE, ACCURATE, SECURE, OR DELIVERED TO ANY PARTICULAR DEVICE, BROWSER, OPERATING SYSTEM, OR PLATFORM.
NOTHING IN THIS SECTION EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SACONDE SHALL NOT BE LIABLE FOR LOSSES ARISING SOLELY FROM THE DELAY, FAILURE, INTERRUPTION, DUPLICATION, SUPPRESSION, OR NON-DELIVERY OF A NOTIFICATION, EXCEPT TO THE EXTENT SUCH LIABILITY CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
THIS PROVISION DOES NOT LIMIT ANY RIGHTS OR REMEDIES THAT CANNOT LAWFULLY BE WAIVED.
Any dispute arising from or relating to these Notification Terms shall be governed by the applicable governing-law, dispute-resolution, arbitration, class-action waiver, jury-trial waiver, and other dispute provisions contained in Saconde's Terms and Conditions or Terms of Use, to the extent enforceable and applicable.
If no such provisions apply, the dispute shall be governed by applicable law.
If any provision of these Notification Terms is determined to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.
Saconde's failure to enforce any provision of these Notification Terms shall not constitute a waiver of that provision or any other right.
