1. INTRODUCTION
These User Content, Reviews, and Community Terms (“Community Terms”) govern the submission, creation, uploading, posting, publication, transmission, sharing, display, storage, moderation, use, and removal of User Content through or in connection with Saconde & Saconde, LLC (“Saconde,” “Company,” “we,” “us,” or “our”).
These Community Terms apply to User Content submitted through or relating to:
- www.saconde.com and any Saconde-operated websites;
- Saconde mobile applications made available for iOS, Android, or other supported platforms;
- Saconde online accounts, profiles, marketplaces, product pages, seller portals, buyer portals, and customer-service systems;
- Saconde’s retail location, showroom, events, appointments, authentication services, consignment services, buyout services, and other in-person interactions;
- reviews, ratings, testimonials, questions, answers, comments, messages, discussion features, community forums, surveys, and feedback tools;
- photographs, videos, audio recordings, product images, documents, authentication materials, and other files submitted to Saconde;
- social-media content submitted to Saconde, tagged with Saconde accounts, or authorized for Saconde’s use;
- promotional campaigns, contests, sweepstakes, referral programs, creator programs, influencer campaigns, and brand collaborations; and
- any other service, platform, feature, communication channel, or interface that links to or incorporates these Community Terms.
These Community Terms supplement Saconde’s Terms and Conditions, Buyer Terms or Terms of Sale, Seller Terms and Conditions, Privacy Policy, Cookie Policy, Intellectual Property Policy, and any other agreement applicable to your use of Saconde’s services.
If another Saconde agreement contains more specific terms governing particular User Content, the more specific terms will control to the extent of a direct conflict.
2. ACCEPTANCE OF THESE COMMUNITY TERMS
By submitting, posting, uploading, transmitting, sharing, displaying, tagging, sending, or otherwise making User Content available to Saconde or through the Services, you acknowledge that you have read, understood, and agreed to these Community Terms.
You may not submit User Content if you do not agree to these Community Terms.
Nothing in these Community Terms requires you to submit a review, testimonial, rating, photograph, video, comment, or other User Content.
3. DEFINITION OF USER CONTENT
“User Content” means any information, material, or content submitted, provided, generated, uploaded, posted, transmitted, displayed, shared, tagged, or otherwise made available by a user, customer, seller, consignor, buyer, visitor, account holder, reviewer, creator, influencer, employee, contractor, or other third party.
User Content includes, without limitation:
- product reviews and seller or buyer reviews;
- star ratings and numerical ratings;
- testimonials and endorsements;
- comments, replies, questions, and answers;
- usernames, profile names, biographies, and profile photographs;
- photographs, images, graphics, artwork, and screenshots;
- video and audio recordings;
- product descriptions and item-condition descriptions;
- authentication photographs, receipts, serial-number images, ownership records, and supporting documents;
- social-media posts, tags, mentions, hashtags, and direct submissions;
- messages sent through community, account, or marketplace features;
- reports, complaints, disputes, and feedback;
- survey responses and suggestions;
- contest, promotion, or campaign entries;
- product styling, modeling, unboxing, or demonstration content; and
- metadata associated with submitted files, including dates, device information, geolocation information when enabled, and file properties.
User Content does not include content created and published solely by Saconde without material contribution from a user.
4. ELIGIBILITY AND MINORS
You must be at least eighteen years old or the age of legal majority in your jurisdiction to create an account, participate in transactional community features, or submit User Content connected with the purchase, sale, consignment, authentication, or transfer of luxury goods.
A parent or legal guardian may submit limited User Content involving a minor only when legally permitted and only if the parent or guardian has authority to provide all required permissions.
You may not submit photographs, videos, identifying information, precise location information, school information, financial information, or other sensitive information concerning a minor unless:
- you are the minor’s parent or legal guardian or have documented authorization from the parent or guardian;
- the submission is lawful;
- the information is reasonably necessary for the purpose for which it is submitted; and
- you have obtained any legally required consent.
Saconde may remove content involving minors, restrict the relevant account, or request proof of parental or guardian authorization.
5. RIGHT TO POST HONEST REVIEWS
Saconde supports the right of consumers to express honest opinions about Saconde, its products, services, employees, contractors, sellers, consignors, buyers, locations, and business practices.
Nothing in these Community Terms is intended to:
- prohibit or restrict an honest review;
- require a review to be positive;
- penalize a consumer merely for expressing a negative opinion;
- impose a fee or financial penalty solely because a review is negative;
- require a consumer to remove a lawful negative review;
- prevent a consumer from reporting suspected unlawful conduct to a government agency, regulator, law-enforcement authority, consumer-protection organization, or attorney;
- prohibit a consumer from making a truthful statement about Saconde’s goods, services, or conduct; or
- waive rights that cannot lawfully be waived under the Consumer Review Fairness Act, Federal Trade Commission requirements, state consumer-protection laws, or other applicable law.
Saconde may nevertheless restrict or remove content that is unlawful or that otherwise violates these Community Terms, including content containing confidential information, personal information, threats, harassment, impersonation, intellectual-property infringement, knowingly false factual assertions, fake reviews, undisclosed conflicts of interest, or content unrelated to the relevant transaction or service.
A negative opinion is not prohibited merely because Saconde disagrees with it or believes it is unfair.
6. REVIEW AUTHENTICITY AND ACCURACY REQUIREMENTS
Reviews, ratings, testimonials, and endorsements must reflect the reviewer’s genuine experience, honest opinion, and actual knowledge.
You may not submit or arrange for:
- a review by a person who did not have the experience described;
- a review concerning a nonexistent transaction, product, service, appointment, or interaction;
- a materially false or misleading review;
- a review generated or substantially fabricated by artificial intelligence when it is represented as the genuine experience of a real person;
- a review copied from another person or source without authorization;
- a review submitted through a false identity, impersonated identity, or misleading account;
- multiple reviews intended to manipulate an aggregate score or rating;
- coordinated review bombing or coordinated artificial rating manipulation;
- the purchase, sale, or exchange of fake reviews;
- a review based solely on hearsay that is presented as a firsthand experience;
- a review containing materially altered or fabricated evidence;
- a review submitted for the purpose of extortion, blackmail, retaliation, coercion, or obtaining an improper benefit;
- a review of a competitor submitted without clearly disclosing a relevant competitive relationship;
- an insider review without required disclosure; or
- any other review prohibited by Federal Trade Commission rules or applicable federal or state law.
You should distinguish factual statements from opinions. Statements of fact must be based on information you reasonably believe to be accurate.
Saconde may request information reasonably necessary to verify that a review relates to a genuine experience, such as an order number, appointment date, account information, product information, or other transaction details. Saconde will not require a reviewer to prove the subjective truth of an honestly held opinion merely because the opinion is negative.
7. INCENTIVIZED REVIEWS, ENDORSEMENTS, AND MATERIAL CONNECTIONS
You must clearly and conspicuously disclose any material connection that could affect the weight or credibility of your review, testimonial, endorsement, or other User Content.
A material connection may include:
- payment or compensation;
- free or discounted products or services;
- gifts, credits, rebates, refunds, loyalty points, contest entries, or promotional benefits;
- employment or independent-contractor relationships;
- ownership, investment, agency, family, household, or close personal relationships;
- affiliate, referral, influencer, ambassador, or creator relationships;
- a business or competitive relationship; or
- any other benefit or relationship that a reasonable consumer would not ordinarily expect.
Disclosures must be understandable, noticeable, and placed close to the relevant endorsement. A disclosure hidden in a profile, behind a link, at the end of a long post, or among unrelated hashtags may be insufficient.
Saconde will not condition an incentive on a review expressing a particular positive or negative sentiment. Where Saconde offers an incentive for submitting a review, the incentive must be available regardless of whether the review is positive, neutral, or negative, unless otherwise permitted by applicable law.
Employees, officers, owners, managers, contractors, agents, family members, and other insiders may not submit reviews of Saconde or its products or services without clearly disclosing their relationship.
8. VERIFIED PURCHASE AND OTHER LABELS
Saconde may use labels such as:
- “Verified Purchase”;
- “Verified Seller”;
- “Verified Consignor”;
- “Verified Transaction”;
- “Incentivized Review”;
- “Employee”;
- “Partner”;
- “Brand Ambassador”;
- “Saconde Response”; or
- similar designations.
A “Verified Purchase” or similar designation generally means that Saconde’s records indicate that the account was associated with the relevant transaction. It does not mean that Saconde independently verified every factual assertion contained in the review.
Saconde may add, remove, or correct labels to prevent consumer confusion or comply with applicable law.
Users may not falsify, obscure, or misrepresent their eligibility for a verification label.
9. PROHIBITED USER CONTENT
You may not submit, post, transmit, or share User Content that:
9.1 Illegal or Harmful Content
- violates any federal, state, local, tribal, territorial, or foreign law;
- promotes, solicits, facilitates, or instructs others to commit unlawful conduct;
- constitutes fraud, theft, money laundering, trafficking, evasion, or another unlawful scheme;
- promotes the sale or distribution of stolen, counterfeit, illegally imported, or otherwise unlawful goods;
- creates an unreasonable risk of physical harm, financial harm, or property damage; or
- interferes with an investigation, legal proceeding, regulatory inquiry, or law-enforcement request.
9.2 Counterfeit and Authentication Misrepresentations
User Content may not:
- knowingly describe a counterfeit or inauthentic item as authentic;
- contain fabricated receipts, certificates, authentication records, serial numbers, date codes, ownership records, or provenance;
- misrepresent the condition, brand, model, material, age, source, ownership, or authenticity of an item;
- falsely claim that an item was authenticated, approved, certified, or guaranteed by Saconde or another party;
- misuse Saconde’s name, trademarks, reports, or communications to imply authentication or approval that was not provided;
- conceal material alterations, repairs, substitutions, missing components, or authenticity concerns; or
- encourage users to bypass Saconde’s authentication or transaction controls.
9.3 Threats, Harassment, and Abuse
User Content may not:
- threaten violence, property damage, stalking, or other harm;
- harass, intimidate, bully, shame, or repeatedly target another person;
- encourage self-harm or harm to others;
- contain hateful or dehumanizing attacks based on a legally protected characteristic;
- disclose or threaten to disclose private information for purposes of intimidation;
- encourage coordinated harassment or abuse; or
- contain graphic violence or other disturbing material without legitimate context and appropriate warning.
9.4 Defamation and Knowingly False Statements
User Content may not contain statements of fact that you know are false or that you publish with unlawful disregard for their truth or falsity.
This restriction does not prohibit:
- honestly held opinions;
- truthful accounts of personal experiences;
- good-faith complaints;
- fair comment;
- legally protected criticism; or
- reports to government agencies or law enforcement.
9.5 Privacy and Personal Information
User Content may not disclose another person’s personal or sensitive information without lawful authority.
Prohibited disclosures may include:
- home addresses or precise residential locations;
- personal telephone numbers or private email addresses;
- Social Security numbers, taxpayer identifiers, passport numbers, driver’s-license numbers, or other government identifiers;
- financial-account, payment-card, bank, routing, or authentication information;
- passwords, access codes, security answers, or account credentials;
- private medical, disability, biometric, genetic, or health information;
- immigration records or other confidential legal records;
- nonpublic information concerning a minor;
- private communications submitted without authority;
- unredacted identity-verification documents; or
- any information posted for doxxing, identity theft, fraud, or harassment.
Do not include sensitive information in a public review. Information needed to resolve a complaint should be sent through Saconde’s designated private customer-service channel.
9.6 Intellectual-Property Violations
User Content may not infringe or misappropriate:
- copyrights;
- trademarks or trade dress;
- patents;
- rights of publicity;
- rights of privacy;
- moral rights;
- trade secrets;
- confidential information;
- contractual rights; or
- any other proprietary right.
9.7 Impersonation and Misrepresentation
User Content may not:
- impersonate another person, business, brand, government authority, or Saconde representative;
- falsely imply affiliation, sponsorship, endorsement, authorization, or partnership;
- use misleading account information;
- falsely claim professional credentials or authority; or
- manipulate identifiers to conceal the source of content.
9.8 Commercial Solicitation and Off-Platform Transactions
Unless expressly authorized by Saconde, User Content may not:
- advertise competing services;
- solicit users for off-platform transactions;
- direct users to make payment through personal payment accounts;
- publish referral codes, affiliate links, or unrelated promotions;
- solicit investments, loans, donations, or financial assistance;
- recruit users for pyramid, multilevel-marketing, or similar programs;
- promote spam, mass messaging, or deceptive lead-generation activity;
- attempt to bypass Saconde’s fees, authentication procedures, dispute processes, or transaction controls; or
- facilitate side deals involving items introduced through Saconde.
9.9 Malware and Technical Interference
User Content may not contain or distribute:
- viruses, worms, Trojan horses, ransomware, spyware, or malicious code;
- scripts intended to scrape, overload, disable, interfere with, or gain unauthorized access to systems;
- deceptive links, phishing content, or credential-harvesting tools;
- files designed to evade security screening; or
- code or instructions intended to compromise another person’s device or account.
9.10 Sexually Exploitative or Obscene Content
User Content may not contain:
- child sexual-abuse material;
- sexual exploitation or trafficking content;
- nonconsensual intimate imagery;
- sexual content involving minors;
- unlawful obscene material;
- content soliciting sexual services where prohibited; or
- intimate imagery posted without the depicted person’s authorization.
Saconde may report suspected child exploitation or other unlawful content to the National Center for Missing & Exploited Children, law enforcement, or other appropriate authorities.
10. PRODUCT PHOTOGRAPHS, VIDEOS, AND AUTHENTICATION MATERIALS
When submitting product photographs, videos, receipts, serial numbers, date codes, certificates, ownership records, or authentication materials, you represent and warrant that:
- the submitted materials accurately depict or relate to the item identified;
- you have not materially altered the materials to mislead Saconde or another user;
- you have the legal right to possess and submit the materials;
- the materials do not contain unlawfully obtained personal information;
- you have redacted unnecessary payment, identity, account, and security information;
- the materials do not falsely imply authenticity, ownership, provenance, or authorization; and
- the submission complies with Saconde’s Seller Terms, Authentication Terms, Privacy Policy, and other applicable agreements.
Saconde may analyze submitted images, documents, and metadata using employees, contractors, authentication specialists, service providers, automated tools, fraud-detection systems, and artificial-intelligence-assisted systems.
Automated or AI-assisted review may help identify inconsistencies, duplicates, manipulation, counterfeit indicators, fraud patterns, or policy violations. Material decisions may also be subject to human review where appropriate or legally required.
11. OWNERSHIP OF USER CONTENT
As between you and Saconde, you retain any ownership rights you lawfully hold in your original User Content.
These Community Terms do not transfer ownership of your review to Saconde.
You are not required to assign Saconde exclusive ownership of an honest consumer review as a condition of purchasing or using Saconde’s goods or services.
The license in Section 12 is nonexclusive and is intended to allow Saconde to operate, display, moderate, distribute, and promote the Services and the User Content you choose to provide.
12. LICENSE TO SACONDE
By submitting User Content, you grant Saconde a nonexclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, format, adapt for technical purposes, translate, publish, display, perform, distribute, communicate, and otherwise use the User Content in connection with:
- operating and providing the Services;
- displaying the User Content on Saconde’s website, apps, product pages, profiles, or community features;
- moderating, reviewing, investigating, and enforcing these Community Terms;
- preventing fraud, counterfeiting, abuse, and security incidents;
- responding to customer-service requests and transaction disputes;
- improving products, services, moderation systems, authentication tools, and user experience;
- creating backups and maintaining business records;
- complying with legal, regulatory, insurance, accounting, and record-retention requirements; and
- marketing or promoting Saconde, but only to the extent permitted by applicable law and subject to any separate consent required for use of your name, likeness, testimonial, or endorsement.
This license includes the right to make reasonable technical modifications, such as resizing, cropping, compressing, reformatting, captioning, translating, or adapting content for different devices and platforms. Saconde will not materially alter the meaning of a consumer review in a misleading manner.
Where separate consent is legally required to use a person’s name, image, likeness, voice, testimonial, or endorsement in advertising, Saconde will seek that consent or rely on another lawful basis before such advertising use.
You may request that Saconde stop using eligible User Content for future promotional purposes by contacting hello@saconde.com. The request will not require Saconde to:
- recall materials already lawfully printed or distributed;
- delete records that must be retained for legal, fraud-prevention, security, accounting, or dispute purposes;
- remove content from third-party services not controlled by Saconde;
- remove content where continued use is otherwise authorized by law; or
- remove an accurate historical record of a transaction where retention is reasonably necessary and lawful.
13. YOUR REPRESENTATIONS AND WARRANTIES
Each time you submit User Content, you represent and warrant that:
- you own the User Content or have all rights, permissions, licenses, and consents needed to submit it and grant the license stated in these Community Terms;
- the User Content is based on a genuine experience when presented as a review or testimonial;
- the User Content is not materially false, deceptive, or misleading;
- you have disclosed any material connection or incentive;
- the User Content does not violate another person’s intellectual-property, privacy, publicity, confidentiality, or contractual rights;
- the User Content complies with applicable law;
- you have obtained permission from identifiable individuals appearing in the User Content when required;
- you have authority to submit any business, employment, transaction, or ownership information contained in the User Content;
- the User Content does not contain malicious code or hidden technical functions;
- the User Content does not falsely imply that Saconde endorses, authenticates, certifies, or guarantees you, an item, or a statement; and
- the User Content complies with these Community Terms and all other applicable Saconde agreements.
These representations do not require you to guarantee that an honestly stated opinion is objectively correct.
14. SACONDE’S MODERATION RIGHTS
Saconde may, but is not obligated to, monitor, screen, review, label, organize, restrict, reject, edit, redact, disable, preserve, investigate, or remove User Content.
Saconde may take action when it reasonably believes that User Content:
- violates these Community Terms;
- violates another Saconde agreement;
- is unlawful or potentially unlawful;
- creates fraud, counterfeit, security, safety, privacy, or reputational risks;
- contains sensitive personal information;
- is irrelevant, duplicative, spam-like, or technically harmful;
- results from artificial manipulation;
- requires a disclosure or correction;
- is subject to a valid intellectual-property complaint;
- is subject to a court order, subpoena, government request, or legal obligation; or
- may expose Saconde or another person to liability or harm.
Moderation actions may include:
- declining to publish content;
- temporarily withholding content for review;
- adding a disclosure, warning, verification label, or contextual information;
- redacting personal information;
- limiting visibility or distribution;
- removing content;
- disabling comments or replies;
- suspending or terminating accounts;
- restricting access to community or transaction features;
- preserving evidence;
- referring a matter to a payment provider, marketplace, insurer, brand owner, authentication provider, regulator, or law-enforcement authority; and
- pursuing remedies available under Saconde’s agreements or applicable law.
Saconde is not required to remove a review merely because it is negative, critical, unfavorable, or disputed.
15. REVIEW DISPLAY, SORTING, AND SUPPRESSION
Saconde may display, organize, filter, summarize, sort, or rank reviews using disclosed or reasonably understandable criteria, including:
- recency;
- relevance;
- verified-transaction status;
- helpfulness votes;
- product or service category;
- language;
- content quality;
- fraud or authenticity indicators;
- legal or policy compliance; and
- technical compatibility.
Saconde will not knowingly misrepresent that displayed reviews represent all submitted reviews when material reviews have been excluded based solely on negative sentiment.
Saconde may exclude or remove reviews for legitimate content-neutral reasons, including:
- violation of these Community Terms;
- fake or manipulated activity;
- lack of relevance;
- duplicate content;
- personal-information exposure;
- intellectual-property infringement;
- threats or harassment;
- unlawful content;
- technical errors;
- inability to verify that the review relates to the identified product or service where verification is reasonably required; or
- other lawful moderation criteria applied without regard solely to whether the review is positive or negative.
Saconde may publish statistical summaries or AI-assisted summaries of reviews, provided that Saconde does not knowingly distort the overall substance or sentiment of the underlying reviews.
16. EDITING AND REMOVING YOUR CONTENT
Where the relevant feature permits, you may edit or delete your own User Content through your account.
You may also request review, correction, or removal by contacting hello@saconde.com and providing sufficient information to identify the content.
Saconde may retain:
- archival or backup copies;
- transaction and authentication records;
- records relating to disputes, fraud, chargebacks, counterfeiting, or enforcement;
- records required by law;
- evidence of consent or disclosure;
- content necessary to protect legal rights; and
- deidentified or aggregated information that no longer reasonably identifies you.
Deleting content from public display does not necessarily delete all copies from Saconde’s systems immediately.
17. REPORTING CONTENT AND APPEALS
Users may report suspected violations by contacting hello@saconde.com.
A report should include, where available:
- the location or URL of the content;
- the username or account associated with the content;
- a description of the concern;
- supporting information or documentation;
- the reporter’s contact information; and
- the specific right, policy, or law allegedly violated.
Saconde may request additional information before acting.
Where Saconde offers an internal appeal process, a user may request reconsideration of a moderation decision. Saconde may uphold, reverse, or modify the decision based on the available information.
Submitting repeated, fraudulent, retaliatory, or knowingly false reports may itself violate these Community Terms.
18. COPYRIGHT COMPLAINTS AND DMCA PROCEDURE
Saconde respects intellectual-property rights and may remove or disable access to content that allegedly infringes copyright.
A copyright owner or authorized agent seeking removal under the Digital Millennium Copyright Act should send a written notice to Saconde’s designated copyright contact.
Until Saconde publishes a separate designated-agent address, notices may be sent to:

A DMCA notice should include:
- the physical or electronic signature of the copyright owner or authorized agent;
- identification of the copyrighted work claimed to have been infringed or, for multiple works, a representative list;
- identification of the allegedly infringing material and information reasonably sufficient to locate it;
- the complaining party’s address, telephone number, and email address;
- a statement that the complaining party has a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
- a statement, made under penalty of perjury, that the notice is accurate and that the complaining party is authorized to act for the copyright owner.
Saconde may provide the notice to the user who submitted the challenged content.
A user whose content was removed may submit a legally compliant counter-notification containing:
- the user’s physical or electronic signature;
- identification of the removed material and its former location;
- a statement under penalty of perjury that the user has a good-faith belief that the material was removed or disabled because of mistake or misidentification;
- the user’s name, address, and telephone number;
- consent to the jurisdiction of the appropriate federal district court; and
- acceptance of service of process from the person who submitted the original notice or that person’s agent.
Saconde may restore content when legally permitted.
Saconde may terminate, in appropriate circumstances, accounts of users who repeatedly infringe intellectual-property rights.
Submitting a knowingly false DMCA notice or counter-notification may result in legal liability.
Saconde should separately register and maintain a current designated DMCA agent with the United States Copyright Office to the extent Saconde seeks protection under applicable DMCA safe-harbor provisions.
19. TRADEMARK, COUNTERFEIT, AND BRAND-RIGHTS COMPLAINTS
Trademark owners, brand representatives, and authorized agents may report alleged trademark infringement, counterfeiting, false affiliation, or misuse of brand assets by contacting hello@saconde.com.
A complaint should include:
- the complainant’s identity and authority;
- the trademark or brand right at issue;
- registration information, if applicable;
- the specific content or listing at issue;
- an explanation of the alleged violation;
- supporting documents;
- a good-faith statement; and
- accurate contact information.
Saconde may request proof of authorization, brand ownership, registration, chain of title, test purchases, authentication results, or other supporting information.
Saconde may disclose the complaint to the affected user when appropriate.
20. PRIVACY AND PUBLIC CONTENT
User Content posted through public or community-facing features may be visible to the public, indexed by search engines, copied by other users, shared through third-party platforms, or retained by third parties.
Do not post information you wish to keep private.
Saconde processes personal information associated with User Content in accordance with its Privacy Policy and applicable federal and state privacy laws.
Depending on your state of residence and subject to applicable exceptions, you may have rights concerning access, correction, deletion, portability, restriction, appeal, or other processing of personal information.
Requests concerning privacy rights should be submitted using the method identified in Saconde’s Privacy Policy or by contacting hello@saconde.com.
Saconde may redact or remove personal information from public content without removing the entire review.
21. FACIAL IMAGES, VOICE, LIKENESS, AND BIOMETRIC INFORMATION
User Content may include facial images, voice recordings, video, or other information that could identify a person.
Unless expressly stated in a separate notice and consent:
- Saconde does not intend the general submission of photographs or videos to constitute consent to collect legally regulated biometric identifiers;
- Saconde will not use a person’s image to create a biometric identifier for biometric identification without any notice and consent required by applicable law;
- a user must not submit biometric templates, facial-recognition profiles, voiceprints, fingerprints, or similar regulated biometric data concerning another person without lawful authority; and
- any Saconde biometric-login feature will be governed by Saconde’s separate Biometric Login Notice and Consent and Biometric Retention and Destruction Policy.
Ordinary photographs and videos may still constitute personal information under applicable privacy laws even when they are not used for biometric identification.
22. ARTIFICIAL INTELLIGENCE AND AUTOMATED TOOLS
Saconde may use automated systems and artificial-intelligence-assisted tools to:
- detect spam, fraud, duplication, manipulation, threats, or prohibited content;
- identify counterfeit or authentication concerns;
- classify and organize User Content;
- translate content;
- create summaries;
- improve search and recommendations;
- moderate images, text, audio, or video;
- detect undisclosed commercial relationships; and
- improve Saconde’s services.
Automated systems may make mistakes. Saconde may provide human review or an appeal mechanism where appropriate, feasible, or legally required.
Users must not use AI tools to fabricate consumer experiences, impersonate real customers, create fake reviews, manufacture evidence, or evade Saconde’s moderation systems.
AI assistance used solely for spelling, grammar, translation, accessibility, or organization does not necessarily make content prohibited, provided the underlying experience and statements remain genuine and accurate.
23. COMMUNITY INTERACTIONS AND USER RESPONSIBILITY
Users are responsible for their interactions with other users.
Saconde does not guarantee:
- the identity of any user;
- the accuracy of User Content;
- the authenticity of an item based solely on a user statement;
- the reliability of a reviewer;
- the safety of an off-platform interaction; or
- the performance of an agreement made outside Saconde’s authorized transaction process.
You should not send money, goods, passwords, verification codes, identification documents, or financial information to another user outside Saconde’s approved procedures.
Saconde is not responsible for off-platform arrangements that Saconde did not authorize or control.
24. NO PROFESSIONAL OR AUTHENTICATION RELIANCE
User Content reflects the views of its author and is not necessarily verified, endorsed, adopted, or approved by Saconde.
User Content does not constitute:
- legal advice;
- financial or tax advice;
- professional appraisal advice;
- investment advice;
- an authentication determination;
- a guarantee of authenticity;
- a warranty regarding condition or value; or
- an official statement by Saconde.
Official Saconde authentication, appraisal, pricing, transaction, or customer-service determinations will be communicated through authorized Saconde channels.
25. USER CONTENT DISCLAIMER
To the fullest extent permitted by law:
- Saconde is not responsible for User Content created by third parties;
- Saconde does not endorse every opinion expressed by users;
- Saconde does not guarantee that all User Content will be accurate, complete, current, lawful, or appropriate;
- Saconde is not obligated to pre-screen all User Content;
- Saconde may not be able to prevent users from copying or redistributing public content; and
- use of or reliance on User Content is at the user’s own risk.
Nothing in this section limits liability that cannot lawfully be limited.
26. ENFORCEMENT AND ACCOUNT ACTIONS
A violation of these Community Terms may result in:
- a warning;
- rejection or removal of User Content;
- limitation of content visibility;
- suspension of posting privileges;
- account restrictions;
- cancellation of unauthorized listings or transactions;
- suspension or termination of an account;
- preservation or disclosure of relevant records where legally permitted;
- referral to a payment processor, marketplace, insurer, brand owner, authentication provider, regulator, or law-enforcement authority;
- recovery of losses where permitted by applicable agreements and law; or
- other appropriate legal or equitable remedies.
Saconde may consider the severity, frequency, intent, risk, prior violations, and surrounding circumstances when determining an appropriate response.
27. COOPERATION WITH LEGAL AUTHORITIES
Saconde may preserve, review, and disclose User Content and associated account information when Saconde reasonably believes disclosure is necessary to:
- comply with applicable law, legal process, court orders, subpoenas, warrants, or government requests;
- enforce Saconde’s agreements;
- investigate fraud, theft, counterfeiting, safety threats, or security incidents;
- protect the rights, property, and safety of Saconde, its users, or the public;
- respond to an emergency involving danger of death or serious physical injury; or
- exercise or defend legal claims.
Saconde will evaluate requests under applicable law and may object to requests that appear overbroad, invalid, or unlawful.
28. RECORD RETENTION
Saconde may retain User Content and related records for as long as reasonably necessary for:
- providing the Services;
- maintaining transaction and authentication histories;
- resolving complaints and disputes;
- preventing fraud, theft, and counterfeiting;
- enforcing agreements;
- complying with tax, accounting, regulatory, and legal obligations;
- maintaining backups and system security;
- establishing, exercising, or defending legal claims; and
- other purposes disclosed in Saconde’s Privacy Policy.
Retention periods may vary based on the type of content, the user’s relationship with Saconde, applicable law, litigation holds, and operational requirements.
29. STATE-SPECIFIC AND NONWAIVABLE RIGHTS
These Community Terms are intended to apply throughout the United States, including all fifty states and the District of Columbia.
Saconde will apply these Community Terms subject to all applicable federal, state, and local laws, including laws concerning:
- consumer reviews and testimonials;
- unfair or deceptive acts or practices;
- false advertising;
- endorsements and material-connection disclosures;
- privacy and data protection;
- biometric information;
- rights of publicity and likeness;
- defamation;
- intellectual property;
- confidential communications;
- nonconsensual intimate imagery;
- protections for minors;
- discrimination, harassment, and civil rights;
- automatic or algorithmic decision-making where regulated;
- consumer contracts and electronic commerce; and
- government reporting and whistleblower protections.
Nothing in these Community Terms will be interpreted to waive, restrict, or eliminate a right or remedy that cannot lawfully be waived.
Where a state law provides greater protection than these Community Terms, the greater protection will apply to the extent required by law.
No provision will be enforced to:
- prevent an honest consumer review protected by law;
- impose a penalty solely for a lawful negative review;
- prohibit a legally protected report to a regulator or government authority;
- restrict legally protected whistleblowing;
- require assignment of intellectual-property rights in a consumer review where prohibited;
- waive a nonwaivable consumer right;
- authorize unlawful use of a person’s name, image, likeness, voice, or biometric information; or
- limit liability where such a limitation is prohibited by applicable law.
30. INDEMNIFICATION
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Saconde, its affiliates, members, managers, officers, employees, contractors, agents, licensors, and service providers from claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys’ fees arising from or relating to:
- User Content you submit;
- your violation of these Community Terms;
- your infringement or violation of another person’s rights;
- your unlawful or fraudulent conduct;
- your failure to obtain required permissions or disclosures; or
- your misuse of the Services.
This indemnification provision does not require a consumer to indemnify Saconde merely because the consumer submitted an honest, lawful review or exercised a nonwaivable legal right.
This section will be interpreted and limited as necessary to comply with applicable state law.
31. DISPUTES AND INCORPORATION OF GENERAL TERMS
Any dispute relating to these Community Terms will be governed by the dispute-resolution, governing-law, arbitration, class-action waiver, venue, limitations-of-liability, and other general provisions contained in Saconde’s applicable Terms and Conditions, Buyer Terms, Seller Terms, or other controlling agreement.
The applicable dispute provisions are incorporated into these Community Terms by reference.
Nothing in these Community Terms requires arbitration of a claim that cannot lawfully be subjected to arbitration or waives any right that cannot lawfully be waived.
Users may also have the right to submit complaints to the Federal Trade Commission, a state attorney general, a state consumer-protection agency, a privacy regulator, or another government authority.
32. CHANGES TO THESE COMMUNITY TERMS
Saconde may update these Community Terms to reflect:
- changes to the Services;
- new community or review features;
- changes in moderation practices;
- changes in technology;
- changes in applicable law;
- regulatory guidance;
- fraud, safety, or security developments; or
- operational requirements.
The revised version will be posted with an updated effective date.
Where required by law, Saconde will provide additional notice or obtain consent before materially different terms apply.
Changes will not retroactively deprive a consumer of rights that had already accrued or authorize materially different promotional use of previously submitted content where additional consent is legally required.
33. SEVERABILITY
If any provision of these Community Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or modified only to the minimum extent necessary to make it enforceable.
The remaining provisions will remain in effect unless applicable law requires otherwise.
34. NO WAIVER
Saconde’s failure to enforce any provision of these Community Terms does not waive its right to enforce that provision later.
A waiver is effective only if made in writing by an authorized Saconde representative.
