1. PURPOSE OF THIS FORM

Saconde & Saconde, LLC (“Saconde,” “Company,” “we,” “us,” or “our”) provides this Privacy Choices / State Privacy Rights Form so that consumers may exercise privacy rights available under applicable United States federal and state privacy laws.

This Form applies to personal information collected through or in connection with:

Saconde will process an applicable opt-out request even if Saconde does not currently engage in an activity legally defined as a sale. We may retain a record of the request so that we can continue honoring your preference.

G. Right to Opt Out of Sharing for Cross-Context Behavioral Advertising

California residents may request that Saconde not share personal information for cross-context behavioral advertising as defined by California law.

H. Right to Opt Out of Targeted Advertising

Residents of states providing this right may request that Saconde not process personal data for targeted advertising as defined by applicable law.

Where applicable, you may request that Saconde limit certain uses or disclosures of sensitive personal information to uses permitted without a right to limit.

L. Right to Opt Out of Consumer Health Data Collection, Sharing, or Sale

M. Right Concerning Biometric Information

Where applicable, you may request information about, withdraw consent for, or request deletion of biometric identifiers or biometric information maintained by Saconde.

Saconde’s mobile applications may allow you to use device-based features such as Face ID, Touch ID, Android biometric authentication, or similar technology. In ordinary device-based biometric login, the device platform generally performs the biometric match and Saconde receives an authentication result rather than your raw fingerprint or facial template.

Any separate collection of biometric identifiers by or on behalf of Saconde will be governed by applicable notices, consents, and retention requirements.

N. Right to Opt Out of Certain Data-Broker Activities

Where applicable, consumers may have rights involving data brokers, including rights to opt out of sale, request deletion, or use a state-operated data-broker deletion or opt-out mechanism.

Saconde’s availability through a data-broker registry or centralized deletion system, if any, will depend on whether Saconde meets the applicable definition of a data broker.

O. Right to Appeal

Residents of states providing an appeal right may appeal Saconde’s refusal or partial refusal of a privacy request.

P. Right to Non-Discrimination and Equal Service

Saconde will not unlawfully discriminate or retaliate against you for exercising an applicable privacy right.

To protect consumers and prevent unauthorized access, deletion, account takeover, fraud, or identity theft, Saconde may verify your identity before fulfilling certain requests.

14. GLOBAL PRIVACY CONTROL AND UNIVERSAL OPT-OUT MECHANISMS

Where required by applicable law, Saconde will process a recognized Global Privacy Control signal or other legally valid universal opt-out mechanism as a request to opt out of covered sale, sharing, or targeted-advertising activities.

A browser-based signal generally applies to the browser or device transmitting the signal. When you are logged into a Saconde account and applicable law requires it, Saconde may apply the preference to the associated account.

Saconde may not be able to associate a browser or device signal with an offline identity, another device, or an account when the signal does not provide sufficient information or when such association is not legally required.

15. PROCESSING AND RESPONSE PERIODS

16. FEES AND EXCESSIVE REQUESTS

Saconde generally will not charge a fee for processing a valid privacy request.

17. FREQUENCY LIMITATIONS

Certain laws limit how frequently a consumer may submit particular requests, including requests for access to specific pieces of personal information.

Where a statutory frequency limit applies, Saconde may deny or limit a duplicative request submitted within the applicable period. Opt-out and consent-withdrawal rights will be handled according to the separate requirements applicable to those rights.

Saconde will also accept requests from residents of the District of Columbia and U.S. territories when applicable.

Not every state provides the same consumer privacy rights, and some state laws apply only when a business meets specified revenue, processing-volume, business-model, or other thresholds. By accepting requests from every state, Saconde does not represent that every state’s comprehensive privacy law applies to Saconde or that every listed right is available in every circumstance.

When a state does not provide a particular statutory right, Saconde may consider the request voluntarily but may deny or limit it based on operational, security, contractual, or legal requirements.

21. CALIFORNIA

Subject to the California Consumer Privacy Act, as amended by the California Privacy Rights Act, eligible California residents may have rights to:

23. FLORIDA

Eligible Florida residents may have rights under the Florida Digital Bill of Rights or other Florida privacy laws when the applicable law and coverage requirements are satisfied.

These rights may include access, correction, deletion, portability, opt-out rights, and protections involving children, sensitive data, voice or facial recognition technology, precise geolocation, targeted advertising, sale, and profiling.

Because Florida’s comprehensive law applies only to specified covered entities, not every Florida request will qualify under that law. Saconde will also evaluate requests under other applicable Florida and federal laws.

24. NEVADA

Eligible Nevada residents may request to review or correct certain covered information and may direct an operator not to make a covered sale of covered information, subject to Nevada law.

Nevada’s definition of “sale” may differ from definitions used in other states.

Nevada residents may also have rights relating to consumer health data, including rights to access, delete, withdraw consent, and withhold authorization for certain sales, subject to applicable law.

25. WASHINGTON

Washington residents may have rights under the Washington My Health My Data Act concerning consumer health data.

Washington residents may also exercise rights available under other Washington privacy, biometric, health, data-security, and consumer-protection laws.

26. ILLINOIS, TEXAS, AND WASHINGTON BIOMETRIC RIGHTS

Residents may have protections under state biometric privacy laws, including the Illinois Biometric Information Privacy Act, the Texas Capture or Use of Biometric Identifier Act, and Washington biometric privacy law.

Where applicable, these protections may concern:

Device-based biometric login operated by Apple, Google, or a device manufacturer may be performed locally by the device without providing Saconde the underlying biometric identifier.

27. NEW YORK

New York residents may exercise rights available under applicable New York laws governing:

31. GENETIC, HEALTH, AND REPRODUCTIVE OR SEXUAL-HEALTH INFORMATION

Certain states provide specialized protections for genetic data, health data, reproductive or sexual-health information, and information that permits health-related inferences.

Where an applicable law applies, Saconde will honor required rights and consent standards involving:

33. ACCOUNT DELETION

An account-deletion request may result in:

Deleting an account does not necessarily require deletion of all associated personal information. Saconde may retain information needed for transactions, authenticity records, fraud prevention, counterfeit detection, tax, accounting, legal compliance, dispute resolution, insurance, security, and other permitted purposes.

Account deletion may not automatically cancel an open order, active consignment, pending buyout, payment obligation, payout, dispute, claim, investigation, or legal hold.
