These SMS / Text Message Marketing & Communications Terms ("SMS Terms") govern text messaging and certain mobile messaging programs operated by Saconde & Saconde, LLC ("Saconde," "Company," "we," "us," or "our").

These SMS Terms govern your enrollment in, participation in, and receipt of SMS, MMS, text messages, automated text messages, and related mobile communications sent by or on behalf of Saconde.
These SMS Terms apply to messaging programs and communications offered through or in connection with Saconde's:

By affirmatively opting in to or enrolling in an applicable Saconde messaging program, you agree to these SMS Terms.
Saconde's Privacy Policy governs how Saconde collects, uses, processes, discloses, and retains personal information associated with messaging programs. Depending on your relationship with Saconde and the Services or transactions in which you participate, additional agreements may apply, including Saconde's Terms & Conditions, Seller Terms & Conditions, Buyer Terms, Consignment Terms, authentication terms, payment or payout terms, and other applicable policies or agreements.
By affirmatively opting in to an applicable Saconde SMS or mobile messaging program, you expressly consent to receive the categories of messages described in the applicable opt-in disclosure, consent form, checkout page, account setting, website form, mobile application screen, keyword enrollment flow, or other enrollment mechanism.
Where required by applicable law, Saconde will obtain prior express consent or prior express written consent before sending marketing or promotional text messages using automated technology.
Consent to receive marketing or promotional text messages is not a condition of purchasing any goods or services from Saconde.
Providing a mobile telephone number to Saconde does not, by itself, constitute consent to receive marketing or promotional text messages except to the extent otherwise permitted by applicable law or where the individual separately provides the required consent.
Depending on the consent you provide, your relationship with Saconde, your requests, your account activity, and applicable law, messages may be sent using:

You agree to promptly update your information if your mobile telephone number changes or if you are no longer the subscriber, customary user, or authorized user of a telephone number provided to Saconde.

Marketing messages may be recurring.
Transactional, security, authentication, fraud-prevention, customer-support, and operational messages may be sent as needed in connection with your requests, transactions, account activity, security events, or use of the Services.
Saconde does not guarantee any particular message frequency, timing, or delivery schedule unless expressly stated in the applicable messaging-program disclosure.
Message and data rates may apply according to your wireless carrier, service provider, and mobile plan.
You are responsible for any applicable:
Message and data rates may apply to messages sent to and received from Saconde.
Wireless carriers are not liable for delayed or undelivered messages.
You may opt out of receiving marketing or promotional SMS or MMS messages from Saconde at any time by replying STOP to an applicable message or by using another reasonable opt-out method made available by Saconde.
Where supported by Saconde's messaging systems, customary opt-out keywords may include:
Opt-out instructions are not case-sensitive.
Saconde will process valid opt-out and revocation requests as soon as reasonably practicable and within the time required by applicable law.
After submitting an opt-out request, you may receive one final non-marketing message confirming that your opt-out request has been received or processed.

If your mobile number is disconnected, deactivated, transferred, reassigned, or otherwise no longer under your control, any prior consent provided by you does not constitute consent on behalf of a subsequent subscriber, user, or owner of that number.
Saconde may use reasonable measures and third-party services to identify telephone numbers that have been disconnected, deactivated, transferred, or reassigned and may suspend or terminate communications to such numbers.

Push notifications are not SMS or MMS messages and may be governed by separate device permissions, operating-system settings, application settings, privacy disclosures, and applicable terms.
If you enable push notifications for a Saconde mobile application, Saconde may send notifications concerning:
You may generally disable push notifications through your mobile device settings, operating-system settings, or application settings.
Disabling push notifications does not necessarily affect SMS, MMS, email, telephone, in-app, or other communications.
Similarly, opting out of SMS marketing does not necessarily disable push notifications, email marketing, or other communication channels. Communication preferences may need to be managed separately for each channel.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SACONDE AND ITS AFFILIATES, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO SMS, MMS, TEXT MESSAGING, MESSAGE DELIVERY, MESSAGE DELAYS, MESSAGE FAILURES, OR PARTICIPATION IN A MESSAGING PROGRAM.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SACONDE'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO SMS, MMS, TEXT MESSAGING, OR A MESSAGING PROGRAM SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Nothing in these SMS Terms excludes, restricts, waives, or limits any liability, remedy, or right that cannot lawfully be excluded, restricted, waived, or limited under applicable law.
This Section is subject to any additional limitation-of-liability provisions contained in other applicable Saconde agreements.
Saconde may modify these SMS Terms from time to time.
Updated versions will be posted with a revised effective date or last-revised date.
Where required by applicable law, Saconde will provide additional notice or obtain renewed consent before materially changing the nature or scope of communications covered by a user's existing consent.
Your continued participation in a messaging program following the effective date of updated SMS Terms constitutes acceptance of the updated SMS Terms to the extent permitted by applicable law.
Changes to these SMS Terms do not retroactively expand the scope of consent previously provided by a user where additional consent is required by applicable law.
Saconde may modify, suspend, discontinue, or terminate any messaging program, feature, short code, long code, toll-free number, telephone number, or communication channel at any time, subject to applicable law.
Saconde may also suspend or terminate an individual's participation where reasonably necessary because of:
Termination of a messaging program does not affect rights or obligations that by their nature should survive termination.
These SMS Terms shall be governed by the laws of the State of New York, without regard to conflict-of-law principles, except to the extent superseded by applicable federal law or other law that cannot lawfully be waived.
Any dispute, claim, or controversy arising out of or relating to these SMS Terms, a Saconde messaging program, or communications sent by or on behalf of Saconde shall be subject to the arbitration, class-action waiver, dispute-resolution, governing-law, venue, and other applicable provisions contained in the Saconde Terms & Conditions or other agreement governing the user's relationship or transaction with Saconde, to the extent applicable and legally enforceable.
Nothing in these SMS Terms shall be interpreted to require arbitration where arbitration cannot lawfully be required or where no valid arbitration agreement applies.
If any provision of these SMS Terms is determined to be invalid, illegal, void, or unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law or, where necessary, severed from these SMS Terms.
The remaining provisions shall remain in full force and effect to the fullest extent permitted by applicable law.
Saconde's failure or delay in exercising or enforcing any right, remedy, power, or provision under these SMS Terms does not constitute a waiver of that or any other right, remedy, power, or provision.
Any waiver must be in writing unless otherwise permitted by applicable law.
These SMS Terms constitute the agreement between you and Saconde concerning the messaging programs specifically governed by these SMS Terms.
Additional Saconde agreements, policies, disclosures, and consent language may apply depending on:
If there is a conflict between these SMS Terms and program-specific consent language concerning the scope of messaging consent, the more specific program-specific consent language will control with respect to that consent, except where prohibited by applicable law.
Nothing in these SMS Terms expands the scope of consent beyond the consent actually provided by you or otherwise permitted by applicable law.
